THIS NOTICE IS FOR INFORMATIONAL PURPOSES ONLY.� THIS IS NOT A REQUEST FOR PROPOSAL.� IT DOES NOT CONSTITUTE A SOLICITATION AND SHALL NOT BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT.� RESPONSES IN ANY FORM ARE NOT OFFERS AND THE GOVERNMENT IS UNDER NO OBLIGATION TO AWARD A CONTRACT AS A RESULT OF THIS ANNOUNCEMENT.� NO FUNDS ARE AVAILABLE TO PAY FOR ANY RESPONSES TO THIS NOTICE.� ANY INFORMATION SUBMITTED BY RESPONDENTS TO THIS NOTICE IS STRICTLY VOLUNTARY. This is a special notice prepared in accordance with Federal Acquisition Regulation (FAR) subpart 5.2 � Synopses of Proposed Contract Actions. �The U.S. Army Corps of Engineers (USACE), Portland District intends to award a firm-fixed-price service contract to the Nez Perce Tribe. �The statutory authority for this non-competitive acquisition is FAR subpart 13.106- 1(b)(1)(i). �USACE and the Bonneville Power Administration (BPA) (Agencies) are jointly responsible for compliance with Sections 106 and 110 of the National Historic Preservation Act (NHPA) under the terms of the 2009 Systemwide Programmatic Agreement (SWPA) for management of historic properties affected by operations of the Federal Columbia River Power System (FCRPS). �USACE, Portland District manages the Bonneville, The Dalles, and John Day Projects, which are part of the FCRPS. �The FCRPS Cultural Resource Program works closely with interested and affected tribes, State Historic Preservation Offices (SHPOs), and other agencies for cultural resource management in compliance with Sections 106 and 110 of the NHPA. The services for this requirement include identify and assess traditional cultural properties along The Dalles-Celilo reach in The Dalles Project associated with historical and ongoing Nez Perce tribal fishing.� The study will describe the Nez Perce Tribe�s historical and ongoing relationship with fishing locations in The Dalles Project and examine fishing in the context of judicial decisions and commercial fishing.� The Nez Perce Tribe (NP) will directly support the Agencies� compliance with Section 106 and 110 of the NHPA by identifying traditional cultural properties (TCPs) and historic properties of religious and cultural significance to tribes (HPRCSITs) through archival research and oral history data regarding locations within The Dalles Projects.� Tasks under this requirement will include the following:� Literature Review:� Conduct an ethnographic overview of previous research on HPRCSITs and/or TCPs within the study area. This study may require a review of resources located in tribal, public, and university collections and repositories and the National Archives in Seattle. They include, but not limited to, a search of previous place name or traditional use studies, oral histories, and collections for ethnographic information relevant to the study area in the context of the traditional territory of the NP who utilized The Dalles Project area. Oral History interviews/Record Transcriptions:� Conduct oral history interviews or use previously recorded/written transcription to identify 5-7 knowledgeable tribal members with information related to the study area.� The Government anticipates the vast majority of previously recorded interviews reside at Nez Perce tribal headquarters. The Contractor shall ensure that all knowledgeable tribal members identified and selected for interviews have adequate knowledge of tribal practices to provide the information necessary to successfully complete the historic context statement. The Contractor shall conduct all interviews and data collection consistent with 45 CFR 46: Protection of Human Subjects. Field Work:� Conduct site visits to The Dalles with knowledgeable tribal members.� The object of the fieldwork is to gather information from knowledgeable tribal members that will inform the National Register eligibility evaluation.� The Contractor shall coordinate with the Government requirement Tech Lead regarding the need to cross private landowners and/or ad-joiners land to access federal lands proposed for survey if they cannot be accessed by public roads.� Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government by submitting a Capability Statement which demonstrates they are able to represent the Nez Perce Tribe on cultural resource matters. �If no affirmative written responses are received by 2:00 PM Pacific Time on Thursday, July 23, 2020, an award will be made without further notice. �A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government. �Electronic responses and questions shall be submitted via email to the contracting points of contact listed below. This notice of intent is NOT a request for competitive proposals.� All responsible sources may submit a capability statement to the Contracting Officer before the notice end date.� If no affirmative written responses are received by 2:00 PM Pacific Time on Thursday, July 23, 2020, an award will be made without further notice.� Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.� Electronic responses and questions shall be submitted via email to the Contract Specialist, Lea Zumwalt, at Lea.M.Zumwalt@usace.army.mil.� The USACE is not responsible for any costs incurred by responding to this notice.
