Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this Notice. This announcement constitutes the only solicitation for which quotations are being requested. Another written solicitation will not be issued. This Request for Quotation (RFQ) document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020-07, effective July 2, 2020. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) requires a contractor to provide an economic analysis on the firearms market in the United States, and those firearms exported from or imported into the United States. This work entails a comprehensive analysis of the firearms market to include those firearms manufactured, sold, and imported by Federal firearms licensees and privately made firearms.� Please read the attached statement of work (SOW) carefully when submitting your quotation response.� The period of performance will be for a duration of two months from the commencement of duties.� After award, the government will work with the contractor to identify milestones and completion dates.� The proposed key personnel must meet the qualifications in Section 2.1 of the SOW.� Any quotation responses that do not meet the minimum requirements in Sections 2.1 and 11 of the SOW will not be considered for award.� The contractor also have recent and relevant past performance for these services.� The Offeror shall provide references for a minimum of three contracts with the Federal Government and/or commercial customers that demonstrate recent and relevant past performance of similar scope, size and complexity.� Recent is defined as within the last three years.� Relevant is defined as work which is the same or similar in complexity, magnitude, and type of the work described in Attachment 1, Statement of Work.� All offerors with relevant past and present performance must send the questionnaire attached to this notice (Attachment 2) to the relevant references to complete.� Those references must submit the questionnaires to the CO no later than the closing date and time of this notice. Award will be made to the responsible offeror whose quotation represents the best value to the Government as determined by the evaluations described in this section. The Government reserves the right to award a contract to other than the low price offeror or offeror with the highest merit rating after consideration of all factors. Selection of the successful offeror will be made based on the evaluation criteria stated below. However, any quotation that is unrealistic, in terms of technical approach, schedule commitments, and or costs (high or low) will be deemed to have an inherent lack of technical competence or to have failed to comprehend the complexity and risk of the Government�s requirement stated in the solicitation. Evaluation Areas: Selecting an offeror for award will be based on an evaluation of quotations against four primary areas: (1) Technical, (2) Past and present performance, and (3) Price. �A quotation that receives an �unsatisfactory� rating in any of factors will not be considered for award. Evaluation Approach: A team of Government personnel will evaluate all quotations. The content of written quotations, as well as information derived from discussions/negotiations, if discussions are held, will be evaluated to determine the degree and extent to which the requirements and objectives set forth in the solicitation are satisfied.� Technical and Past and Present Performance are technical evaluation factors and equally important. When combined, the technical evaluation factors are significantly more important than price. As the technical evaluation of quotations approaches equality, the greater will be the importance of price in making the award determination. In the event that two or more quotations are determined not to have any substantial technical differences (i.e. are technically equivalent), award may be made to the lower priced quotation. It should be noted that award may be made to other than the lowest priced quotation if the Government determines that a price premium is warranted due to technical merit. The Government may also award to other than the highest technically rated quotation, if the Government determines that a price premium is not warranted. � TECHNICAL RATINGS: Technical Ratings Exceptional The Offeror has clearly demonstrated its ability to perform the work defined in the SOW. The quotation possesses numerous (5 or more) strengths and no weaknesses. Very Good The Offeror has clearly demonstrated its ability to perform the work defined in the SOW. The quotation possesses one or more strengths and no weaknesses. Satisfactory The quotation meets the minimum requirements of the SOW. Areas where the quotation may exceed the minimum requirements are considered to be of minor or no value to the Government. There are no strengths or they are offset by several weaknesses. Marginal The Offeror�s quotation does not clearly demonstrate its ability to perform the work defined in the SOW. The quotation possesses numerous (5 or more) weaknesses and no strengths; successful achievement of the PWS requirements may be difficult to achieve or can occur only with increased levels of ATF oversight. Unsatisfactory The quotation fails to meet the minimum requirements of the SOW and has deficiencies or omissions and/or numerous weaknesses. Understanding of Requirements: The quotation will be evaluated based upon the extent to which the quotation demonstrates a clear understanding of all management features involved in meeting the requirements of each Factor. Feasibility of Approach: The quotation will be evaluated based upon the extent to which the proposed management approach is capable of satisfying requirements and is realistically achievable. This includes the extent to which all risks associated with the management approach for each Factor and have been identified and mitigated for successful achievement of the requirements. Completeness: The quotation will be evaluated based upon the extent to which management requirements for each Factor have been considered, defined and satisfied, based upon the offeror�s written quotation. DEFINITIONS A �strength� is an attribute of the Offeror�s proposal which is likely to lead or contribute to successful contract performance. A �weakness� is an attribute of the Offeror�s proposal which is likely to increase the probability of unsuccessful contract performance. A �deficiency� is a material failure of a proposal to meet a Government requirement, as established in the RFQ, and renders the proposal unacceptable; e.g., omits data, making it impossible to assess compliance with the evaluation factors, or contains ambiguities that must be clarified before an assessment of compliance can be made. An �omission� is information requested in the RFQ that was not provided in the proposal. An omission is not necessarily a deficiency if it is not material in nature and the intent of the offeror can be readily determined. A �risk� is an aspect of a proposed approach that has the potential to negatively impact successfully meeting the Government�s needs. Past and Present Performance Ratings: Exceptional Performance met all task order requirements and exceeded many to the government�s benefit. Problems, if any, were negligible and were resolved in a timely, highly effective manner Very Good Performance met all task order requirements and exceeded some to the government�s benefit. There were a few minor problems which the contractor resolved in a timely, effective manner. Satisfactory Performance met task order requirements. There were some minor problems and corrective actions taken by the contractor were satisfactory. Marginal Performance did not meet some contractual requirements. There were problems, some of a serious nature, for which corrective action was only marginally effective. Unsatisfactory Performance did not meet most contractual requirements. There were serious problems and the contractor�s corrective actions were ineffective. Neutral No record of past performance or the record is inconclusive or not relevant to current requirement. This is a small business set-aside using the NAICS code 541690 with a size standard of $15,000,000. Vendors MUST be registered and Active in the System for Award Management (SAM) system (www.SAM.gov) at the time of quotation submission, pursuant to FAR 52.204-7. OPEN MARKET Quotes should be submitted via email to Amanda.Boshears@ATF.gov by the Close of this RFQ, Tuesday, August 11, 2020, 2:00pm EST. The RFQ # (DJA-20-AOCC-PR-0045) must be clearly displayed on the Quote and in the Subject of the email. Quotes MUST be good for 30 calendar days after the close of the RFQ and should be submitted in Good-Faith in order to be responsive.� THE PAGE LIMITATION FOR QUOTATION RESPONSES IS 20 PAGES FOR THE TECHNICAL RESPONSE TO INCLUDE THE PAST PERFORMANCE REFERENCES (VOLUME 1) AND 5 PAGES FOR THE PRICING RESPONSE (VOLUME 2). The selected vendor must comply with the following FAR commercial provisions and clauses, which are incorporated herein by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34.
