The Nashville District plans to clear sediment, debris, and vegetation from the Yellow Creek Bypass Channel, Middlesboro, Bell County, Kentucky. The proposed project is expected to generate approximately 63,000 cubic yards (cy) of material from an approximate 6,300 linear foot section of the channel. Vegetation from the operations would be transported to a processing site to include chipping or burning. Sediment would be temporarily stored on nearby lot and ultimately moved to the Apollo Mine to support a mine reclamation project. The Corps requires assessment of the two temporary use areas where sediment will be temporarily stored and vegetation would be burned. Given the temporary nature of the use areas, the proposed project would not introduce visual effects. Investigations are required to identify the presence of archaeological sites within the project areas. Information from the report will be used by the Corps to complete its obligations under Sections 106 of the National Historic Preservation Act (54 U.S.C. 306108). The Corps previously consulted under 36 CFR 800 on the proposed work within the stream channel and use of the Apollo Mine site for the final disposal of the dredge material. The proposed project involves the removal of up to 63,000 cubic yards material from the Yellow Creek Bypass Channel. The Yellow Creek Bypass Channel was constructed in 1939 to direct flood waters from Yellow Creek and around Middlesboro. The Yellow Creek Bypass Channel requires periodic dredging to maintain operations. Prior dredging projects occurred in 1968, 1977, 1979, 1981, and 2008. The dredge spoil has been placed on various government and private parcels in the past (Figure 2). However, the documentation related to prior disposal sites has not been well recorded. Anecdotal information suggests portions of the two proposed temporary use sites have been used for dredge disposal in the past. The Corps requires verification of the prior use of proposed disposal areas, delineation of undisturbed areas within the proposed disposal areas, and identification of archaeological sites within the proposed temporary use areas.
