Amendment No.: 0001 is for Solicitation no.; 140A2320Q0467 as follows: 1. To extend the response date and time to Monday, September 07, 2020 at 12:00 p.m. (Albuquerque Time) 2. To Change the set aside to ALL SMALL BUSINESSES. ALL OTHER TERMS AND CONDITIONS TO REMAIN THE SAME AND IN FULL FORCE EFFECT. The Bureau of Indian Affairs (BIA) is soliciting offers to procure supplies of 60 cy of 3000 PSI Concrete to be delivered to Kayenta Boarding School in Kayenta, AZ. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Solicitation No. 140A2320Q0467 herein cited is issued as a Request for Quote (RFQ) and will be procured under FAR Part 12, Acquisition of Commercial Items. Solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2020 08. The solicitation is set aside for Small Business All or NONE - Submit your quote as follows: 1. 60 cy of 3000 PSI Concrete: $__________ 7. Freight & Delivery: $________ 8. Applicable taxes. $ _____________. (Navajo Nation Tax and Arizona Tax) Note: The school will call for delivery through the Period of performance of 180 Days. Delivery amount may vary for each delivery not to exceed 60 CY. Award shall be made to the offeror whose offer responds to all line items included in the solicitation. Failure to provide for any item shall render the offer nonresponsive and will be rejected. Incomplete offers will not be considered. Award will be made on an ALL or NONE BASIS. CONTRACT CLAUSES: The following clauses apply to this acquisition: FAR 52.212-1, Instructions to Offerors Commercial Items; FAR 52.212-3, Offeror Representations and Certifications Commercial Items; FAR 52.212-4, Contract Terms and Conditions Commercial Items; and FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items. In paragraph (a) of FAR 52.212-5 the following applies: FAR 52.233-3, Protest After Award (Aug 1996) (31 U.S.C. 3553); FAR 52.233-4, Applicable Law for Breach of Contract Claim (Oct 2004) (Pub. L.108-77, 108-78). In paragraph (b) of FAR 52.212-5(b), the Contractor shall comply with the following FAR clauses that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive order applicable to acquisitions of commercial items: FAR 52.225-1 Buy American Act-Supplies (June 2003) (41 U.S.C. 10a-10d); FAR 52.232-33, Payment by Electronic Funds Transfer-Central Contractor Registration (Oct 2003)(31 U.S.C. 3332); and FAR 52.232-36, Payment by Third Party (May 1999) (31 U.S.C. 3332). FAR clauses are herein incorporated as follows: FAR 52.232-18, Availability of Funds (April 1984); FAR 1452.204-70, Release of Claims � Department of the Interior; and FAR 52.211-6, Brand Name or Equal. The following clauses apply to this solicitation: 1452.226-70 Indian Preference; 1452.226-71 Indian Preference Program; 1452.280-1 Notice of Indian small business economic enterprise set-aside; 1452.280-2 Notice of Indian economic enterprise set-aside; 1452.280-3 Subcontracting limitations; 1452.280-4 Indian economic enterprise representation; and 1480.102 Buy Indian Act acquisition regulations. Signed and dated quotes, along with a completed copy of FAR Clause 52.212-3, Offeror Representations and Certifications�Commercial Items and DIAR 1452.280-4, are due at the Bureau of Indian Affairs, Division of Acquisition, Attention: Mary Jane Johnson by September 01, 2020 @ 12:00 PM Mountain Time.
