****AMMENDMENT 0001**** Section I, paragraph A.2 is hereby revised to add the following: In accordance with 10 U.S.C. � 2371b(f), the Government may award a follow-on production contract or Other Transaction (OT) for any OT awarded under this BAA if: (1) that participant in the OT, or a recognized successor in interest to the OT, successfully completed the entire prototype project provided for in the OT, as modified; and (2) the OT provides for the award of a follow-on production contract or OT to the participant, or a recognized successor in interest to the OT Section I, paragraph A.5 is hereby added as follows: 5. Grants and Cooperative Agreements: Consistent with the regulatory authority in Code of Federal Regulation (CFR), Title 2.A, Chapter II, Part 200, funds may be awarded to stimulate or support a public purpose consistent with objectives to develop, approve, and field medical CBRN countermeasures and enabling biotechnologies. These efforts should be intended for scientific study and experimentation directed toward advancing the state-of-the- art or increasing knowledge or understanding, rather than focusing on a specific system, product, or medical countermeasure. The purpose of grants and cooperative agreements placed under this BAA is to identify the best available science, and as such, there are no set-asides associated with any awards resulting from this BAA. Section III, paragraph A.1.iii is hereby added as follows: iii. Grants/Cooperative Agreements: Consistent with statutory authority, funds may be awarded�� to stimulate or support a public purpose consistent with the broad JPMO mission objectives to develop, approve, and field medical CBRN countermeasures and enabling biotechnologies. These efforts should be intended for scientific study and experimentation directed toward advancing the state-of-the- art or increasing knowledge or understanding, rather than focusing on a specific system, product, or medical countermeasure. A Cooperative Agreement is used to enter into the same kind of relationship as a grant, except that substantial involvement is expected between the DoD and the recipient when carrying out the activity contemplated by the cooperative agreement. The term �Cooperative Agreement� does not include �Cooperative Research and Development Agreements� as defined in 15 USC 3710a. No fee or profit is allowed on Grants or Cooperative Agreements awarded by the Department of Defense. Section IV, paragraph C title is hereby revised as follows: C. TECHNOLOGY INVESTMENT AGREEMENTS (TIA): Is replaced with: C. GRANTS, COOPERATIVE AGREEMENTS, and TECHNOLOGY INVESTMENT AGREEMENTS (TIA): Section V, paragraph A is hereby revised as follows: A. EVALUATION FACTORS FOR PROCUREMENT CONTRACTS: Is replaced with A. EVALUATION FACTORS ((End Amendment 0001)) ************************************************************************************************************* OWS is a partnership among components of the Department of Health and Human Services (HHS), including the Centers for Disease Control and Prevention (CDC), the Food and Drug Administration (FDA), the National Institutes of Health (NIH), and the Biomedical Advanced Research and Development Authority (BARDA), and the Department of Defense (DoD) to coordinate existing HHS-wide efforts, including the NIH�s Accelerating COVID-19 Therapeutic Interventions and Vaccines (ACTIV) partnership, NIH�s Rapid Acceleration of Diagnostics (RADx) initiative, and work by BARDA. As the purpose of this BAA is to identify the best available science in the identified areas of research interest. Proposals are sought from all eligible sources as specified herein, including educational institutions, nonprofit organizations, and private industry and no sources will be excluded. This Broad Agency Announcement (BAA) provides general information, proposal preparation instructions, evaluation and selection criteria, and award administration.
