- THIS IS A SPECIAL NOTICE PREPARED IN ACCORDANCE WITH FEDERAL ACQUISITION REGULATION (FAR) SUBPART 5.2 �SYNOPSES OF PROPOSED CONTRACT ACTIONS� NAICS: 541990 Estimated Ordering Period/Period of Performance:� 5 Years (2020 � 2025) Response Deadline:� 6/10/2020 The U.S. Army Corps of Engineers (USACE), Portland District (NWP) intends to negotiate/award a sole-source contract with the Oregon Department of Fish and Wildlife (ODFW), a State of Oregon agency, to operate and maintain the Bonneville Hatchery on the Columbia River. The specific work will be performed at the Bonneville Fish Hatchery, located 5 miles west of Cascade Locks, Oregon, on the Columbia River. Services include providing all personnel, equipment, tools, materials, vehicles, supervision, and other items necessary to produce and release fish in support of USACE mitigation objectives for The Dalles and John Day Dams. ODFW will carry out fish production, transportation, and release or transfer of fish in accordance with the applicable Hatchery Genetic Management Plan (HGMP) and in compliance with state and federal regulations. ODFW will monitor and account for the health of all fish during the fish production process and appropriately mark and tag the fish prior to release. ODFW will also provide routine maintenance at the hatchery and provide the Government with a bi-annual report detailing the operation, management, and maintenance activities carried out during the relevant period.�� Operation and maintenance services at the Bonneville Fish Hatchery have recently been performed by ODFW under a contract between NWP and ODFW. REASON FOR SOLE SOURCE ACQUISITION: The statutory authority for this non-competitive acquisition is 10 U.S.C 2304(c)(1) as implemented by FAR 6.302-1 and DFARS 206.302-1, Only One Responsible Source and No Other Services Will Satisfy requirements. Bonneville Hatchery possesses a unique situation that requires a sole source contract with ODFW to operate this hatchery. At Bonneville Hatchery, ODFW owns a real estate interest in an abatement pond at the hatchery that must be used to rear the required fish. ODFW�s ownership of this pond precludes using another contractor to perform the required work.� The majority of the land, facilities, and equipment on which Bonneville Hatchery is located is owned or managed by USACE. However, as the hatchery updated infrastructure in the 1970s to meet water quality standards for hatchery effluent, ODFW was deeded a parcel land by the Oregon Department of Transportation for the �purpose of constructing and maintaining pollution abatement facilities for [ODFW�s] fish hatcher[y].� Soon after, ODFW constructed a pollution abatement pond on the parcel. Effluent from several large banks of fish rearing vessels was re-directed to flow into the abatement pond, so that excess fish food, fish excrement, and other organic matter could settle out of the water column to the floor of the pond, before the water was ultimately released into Tanner Creek. The pollution abatement pond is critical to the hatchery activities contemplated in this contract. The banks of rearing ponds that discharge flow into the abatement pond must be utilized to rear the large amount of fish required. No other rearing ponds are available to meet the full amount of fish production required. If the rearing ponds were used, but the abatement pond was not utilized, with water discharged directly into Tanner Creek, it would constitute a violation of Section 402 of the Clean Water Act (1972). It follows that NWP�s required fish production needs cannot be completed without the use of this abatement pond, and ODFW is not willing to convey its interest in these facilities to USACE. Therefore, due to the mixed-ownership issues at Bonneville Hatchery, as explained above, ODFW is the only responsible source capable of fulfilling NWP�s requirements. The Government intends to advertise a solicitation for this project on or around 8/20/2020.� At this time, a solicitation does not exist.� Therefore, offers will not be accepted. �**NO PHONE INQUIRIES, PLEASE. Government-furnished equipment is shown in Attachment 1. The contractor is responsible for providing all other equipment needed to fulfill the requirement, including, but not limited to, juvenile transportation vehicles suitable for transferring live fish, egg incubation trays and stacks, and marking and tagging equipment that provides an adipose fin clipping rate of less than 1% for the tagging groups listed above; Recent and relevant experience providing routine maintenance and janitorial services at fish hatcheries; Examples of recent and relevant aquaculture and hatchery management experience specific to the species and the quantities listed above within the last three (3) years; Examples of recent and relevant experience, within the last three (3) years, coordinating with other agencies regarding hatchery operations.� Highlight any experience working with the Oregon Department of Fish and Wildlife (ODFW), Washington Department of Fish and Wildlife (WDFW), and National Marine Fisheries Service (NMFS) as it pertains to the services described above; Relevant experience complying with Biological Opinions and Hatchery Genetic Management Plans.
