- Description
- The United States of America through the Millennium Challenge Corporation (MCC, for its acronym in English) and the Government of the Republic of El Salvador (the ""Government"" or �GOES�), have entered into a Millennium Challenge Grant Agreement, for an amount of US$365.2 million (US$277 million from United States of America Government, through the Millennium Challenge Corporation and US$88.2 million from the Government of the Republic of El Salvador) (�Grant Agreement""). The Grant will be used to support the following activities: 1) Human Capital Project, 2) Investment Climate Project, 3) Logistical Infrastructure Project; and, 4) the installation and administration costs of the agency responsible for the implementation. The Government, acting through �El Fondo del Milenio II,� from now on referred to as ""FOMILENIO II,"" intends using part of the Funds for eligible payments under the terms and conditions established in the contract resulting from this procedure of selecting a consulting firm, in a transparent and financially viable manner, according to the following detail: Ref. No.: PCP-QBS-4865/2020. EXTERNAL LEGAL SERVICES FOR LITIGATION AND ARBITRATION. Original title in Spanish: �SERVICIOS LEGALES EXTERNOS PARA LITIGIOS Y ARBITRAJES�. CONTRACT PERIOD AND EXECUTION OF SERVICES: 12 calendar months, counted from the written Start Order issued by FOMILENIO II, which may be extended by agreement between the Parties. DATE AND TIME (*1) LIMIT OF RECEIVING PROPOSALS: Friday, November 27, 2020, until 10:00 a.m. Notes: *1, the official time of the Republic of El Salvador (UTC-06:00) Payments from FOMILENIO II shall be subject, in all respects, to the terms and conditions, including restrictions on the use of the MCC funding agreement. No party other than the GOES and FOMILENIO II shall be rights about the Agreement and shall be entitled to claim funds or resources of MCC. Be excluded from participation in this procurement to any person or entity within the blacklist or suspended from participating in procedures funded by the World Bank or Federal Government funding of the United States of America, or otherwise prohibited by the law of the United States of America or executive orders or policies, including under any existing anti-terrorism policy. With this notice, FOMILENIO II aims to obtain Technical and Financial Proposals from consulting firms, which will be evaluated in two stages: in the first stage, the Technical Proposal of all firms is evaluated. Once this evaluation is completed, the results obtained will be communicated and at the same time, the best evaluated consulting firm will be invited to open its Financial Proposal for evaluation and negotiation. If this process is successful, the awarding and contracting will proceed, returning the financial proposals of the non-awarded firms closed and without having been opened. The objective of the services is focused on: having the legal services and timely legal advice to provide support in the area of litigation and arbitration to FOMILENIO II and later to the Government of El Salvador, through the Attorney General's Office (�Fiscal�a General de la Rep�blica�). The Consultant shall provide advice, issue opinions on legal aspects in the area of litigation - arbitration that may be consulted and represent FOMILENIO II and subsequently the Government of El Salvador, through the Attorney General's Office (�Fiscal�a General de la Rep�blica�), in any dispute, litigation - arbitration as required.
