- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) The solicitation number 36C26221Q0187 is issued as a Request for Quotation (RFQ). (iii) The provisions and clauses in this document are in effect through the Federal Acquisition Circular 2005-95, January 19, 2017. (iv) This solicitation is intended to award a total set-aside procurement to a small business, with associated NAICS Code 334516 and business size standard of 1000 employees. (v) The US Government seeks to procure a maintenance and service plan for continuous operations of a four-plate automated ELISA processing system for the South Arizona VA Health Care System (Tucson) Bio-medical Engineering Department. The original equipment manufacturer (OEM) is Dynex Technologies. The model/version is a DSX Automated System with 4 Incubators, item 65400. The successful contractor will meet the requirements described in the statement of work (SOW) under a single-award base contract, with up to four (4) option years. (vi) SOW - SERVICE PLAN COVERED BY THE CONTRACTOR MUST INCLUDE: On-site preventative maintenance (PM) inspection on equipment/systems in accordance with the Original Equipment Manufacturer (OEM) recommendations, including but not limited to: Clean all exterior surfaces Empty Wash Buffer Containers and clean with deionized water. Remove and Clean the Waste Tip Chute. Inspect tubing for leaks, cracks and signs of degradation. Replace the Aspiration Tubing. Replace the Dispense Tubing. Recalibrate Dispense Pumps. Replace the In-Line Vacuum Filter in the vacuum line. Readjust the Vacuum Sensor. Check belt tension on the X-Drive, Y-Drive, and Z-Drive and adjust as required. Reseat all modules. Check Carrier Plate clips and replace as necessary. Check Workspace and coordinate calibrations (according to OEM Post-Service Checkout Protocols). Perform verification of the reader using the appropriate verification plate and perform the Tip Alignment test. Perform temperature verification on the incubators using the proper verification plate. Use of OEM certified parts or parts approved in accordance with OEM standards, including software and required software upgrades. Waste related to services provided will be appropriately removed and disposed of to an offsite location. Preventive maintenance performed at a minimum of two times per year. Preventive maintenance will be scheduled with the COR. Preventative maintenance work must be completed in the month specified during the request unless another date is agreed upon by COR. Unlimited service calls with on-site response within 24 hours (Monday to Friday 8:00 AM to 5:00 PM, Arizona Time). Response: All requests for repair service will be considered requests for emergency service unless a statement to the contrary is made by the COR. A competent service representative will be adequately equipped with tools, test instruments, service manuals, and repair parts to fulfill the requirement by the designated response time. The service representative may contact the COR by phone before arrival. Such contacts, however, will not serve to alter the requirements for arrival on-site except when the request for service is withdrawn by the COR. Engineers/technicians OEM trained on all equipment included in agreement. DOCUMENTATION: Documentation of all service activities reported prior to leaving the site. Reports for preventative maintenance, emergency repair, and safety inspections, must contain the following information: Date(s) and time period of service. Complete description of equipment serviced including model number and serial number. Complete description of equipment services performed including upgrades, updates and software changes made. Complete list of all materials, parts, or assemblies installed or replaced including serial numbers of parts where applicable. A statement of the complaint that initiated the service call. ADDITIONAL REQUIREMENTS: All repairs and preventive maintenance will be performed onsite, unless otherwise required for service resources offsite. The COR will confirm when/if services are required offsite. VA property may not be removed from the SAVAHCS prior to execution, and approval of all documents as required by Acquisition and Materiel Management Service. Computer hard drives and other storage media items may not leave VA property. Requirements for service reports for designated equipment not at this location are the same as for work done on-site. Service reports for incoming equipment requires a signature by the COR at the time of delivery. If equipment is returned via commercial carrier, the service report may be included with the shipment. All required replacement parts, freight, travel expenses are included in service plan. Noncontract Charges: The contractor shall not perform any service that will result in additional charges without prior approval from the Contracting. Payment: Payment will be made in arrears, and upon receipt of a properly prepared invoice which references the period for which payment is due, the contract number and/or assigned purchase order number. The invoice must include the correct payment address. OTHER REQUIREMENTS: Failure to carry out the above procedures will be considered as a failure to document the service visit and will constitute a failure to perform. The contractor is required to obtain the Contracting Officer s approval prior to engaging in any contractual relationship in support of this contract requiring the disclosure of information, documentary material, and/or records generated under or relating to this contract. The contractor is required to abide by Government and Agency guidance for protecting sensitive and proprietary information. It is the responsibility of the contractor to park in the appropriate designated parking areas. Information on parking is available from the COR. The VA will not invalidate or make reimbursement for parking violations of the contractor under any conditions. Smoking is prohibited on the SAVAHCS campus. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court. INSTRUCTION TO THE AWARDEE Prior to arrival at SAVAHCS, contractor is to coordinate access and service with COR. Biomedical Engineering can be reached at 520-792-1450 ext. 16679. Hours: Normal duty hours are 8:00 AM through 5 PM, Arizona Time, Monday through Friday, not including federal holidays. Whenever contact with the COR is required outside of normal duty hours, the Utility System Repair Operator (USRO) may be contacted as an alternate. The hospital operator at extension ""0"" can contact the USRO operator via radio. Upon arrival at the facility, all contractor personnel shall check-in with a valid Driver License or Company ID to the Biomedical Engineering department. Prior to conducting services, the contractor shall be issued a visitor s badge which shall be worn above the waist during the contractor s visit. All contractor personnel (without exception) must report to the Engineering Department, Bldg. 38-room A22, to sign in and receive a contractor identification badge before any work is performed and return to the same location to sign out and turn-in said badge along with the documented service report for the service performed. (vii) Period of performance will be one year from the date of the award at the following FOB Destination: Department of Veterans Affairs South Arizona VA Health Care System 3601 South 6th Avenue Tucson, AZ 85723 (viii) The provision at 52.212-1, Instructions to Offerors Commercial Items, applies to this solicitation. Offerors must certify exemption status to Service Contract Labor Standards FAR 52.222-48, contained herein. (ix) 52.212-2 Evaluation -- Commercial Items (Oct 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: Lowest price technically acceptable. Technical acceptability shall be established by review of each submitted quote by the designated technical evaluator(s) and verification that all requirements listed within the SOW can be met. Submissions to this solicitation must show clear, compelling and convincing evidence that all requirements can be achieved by a single awardee. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. (b) (1) Annual Representations and Certifications. Any changes provided by the Offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM. (2) The offeror has completed the annual representations and certifications electronically in SAM accessed through http://www.sam.gov. After reviewing SAM information, the Offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications--Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), at the time this offer is submitted and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs __. (xiii) 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999) The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days. (End of Clause) 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000) (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered to include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years. 52.222-48 EXEMPTION FROM APPLICATION OF THE SERVICE CONTRACT LABOR STANDARDS TO CONTRACTS FOR MAINTENANCE, CALIBRATION, OR REPAIR OF CERTAIN EQUIPMENT CERTIFICATION (MAY 2014) (a) The offeror shall check the following certification: CERTIFICATION The offeror [ ] does [ ] does not certify that (1) The items of equipment to be serviced under this contract are used regularly for other than Government purposes, and are sold or traded by the offeror (or subcontractor in the case of an exempt subcontractor) in substantial quantities to the general public in the course of normal business operations; (2) The services will be furnished at prices which are, or are based on, established catalog or market prices for the maintenance, calibration, or repair of equipment. (i) An ""established catalog price"" is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public. (ii) An ""established market price"" is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and (3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Labor Standards (1) Will not apply to this offeror, then the Service Contract Labor Standards clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at 52.222-51, Exemption from Application of the Service Contract Labor Standards to Contracts for Maintenance, Calibration, or Repair of Certain Equipment Requirements, in this solicitation will not be included in any resultant contract awarded to this offeror, and the offeror may be provided an opportunity to submit a new offer on that basis. (c) If the offeror does not certify to the conditions in paragraph (a) of this provision (1) The clause in this solicitation at 52.222-51, Exemption from Application of the Service Contract Labor Standards to Contracts for Maintenance, Calibration, or Repair of Certain Equipment Requirements, will not be included in any resultant contract awarded to this offeror; and (2) The offeror shall notify the Contracting Officer as soon as possible, if the Contracting Officer did not attach a Service Contract Labor Standards wage determination to the solicitation. (d) The Contracting Officer may not make an award to the offeror, if the offeror fails to execute the certification in paragraph (a) of this provision or to contact the Contracting Officer as required in paragraph (c) of this provision. (d) The Contractor is responsible for compliance with all the conditions of this exemption by its subcontractors. The Contractor shall determine the applicability of this exemption to any subcontract on or before subcontract award. In making a judgment that the exemption applies, the Contractor shall consider all factors and make an affirmative determination that all of the conditions in paragraphs (a) through (c) of this clause will be met. (e) If the Department of Labor determines that any conditions for exemption in paragraphs (a) through (c) of this clause have not been met, the exemption shall be deemed inapplicable, and the contract shall become subject to the Service Contract Labor Standards statute. In such case, the procedures at 29 CFR 4.123(e)(1)(iv) and 29 CFR 4.5(c) will be followed. (f) The Contractor shall include the substance of this clause, including this paragraph (f), in subcontracts for exempt services under this contract.
