JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC) Procedures followed under FAR subpart�13.5 in accordance with 41 U.S.C.1901 U.S. Department of Energy National Energy Technology Laboratory Renewal of BARRACUDA VIRTUAL REACTOR software licenses Requisition:� 21FE000476 NOI Special Notice:� 89243321NFE000049 Award No: 89243321PFE000386 � I recommend that negotiations be conducted only with CPFD, LLC� for the services described herein: 1.� Identification of the agency and the contracting activity, and specific identification of the document as a �Justification for Other than Full and Open Competition.� >>> The National Energy Technology Laboratory (NETL) seeks award of a contract on a sole source basis to CPFD, LLC for the continued use of its propriety licenses of BARRACUDA VIRTUAL REACTOR software licenses. � 2.� The nature and/or description of the action being approved, i.e. sole source, limited competition, establishment of a new source, etc. >>> This is a Sole Source award to the CPFD, LLC for the continued use of its propriety licenses of BARRACUDA VIRTUAL REACTOR software licenses. � 3.� A description of the supplies or services required to meet the agency�s needs. >>> Renewal of BARRACUDA VIRTUAL REACTOR software licenses. BARRACUDA VIRTUAL REACTOR software licenses allow computational fluid dynamic models to be developed of coal devolatilization, vaporization and tar cracking processes, coal gasification, chemical looping and CO2 sorbent-based capture.� BARRACUDA VIRTUAL REACTOR software allows current CPFD Barracuda models in existence at NETL to be simulated using the exclusive features (grid generator, chemistry models, GUP acceleration) only found in the CPFD software package.� BARRACUDA VIRTUAL REACTOR provides computational fluid dynamic modeling capabilities, along with custom model building capabilities, for use in the design, analysis, and optimization of fossil energy devices used in advanced power generation systems.� NETL has a library of models based on CPDF-Barracuda software and thus must maintain compatibility with these models. � 4.� The statutory authority permitting other than full and open competition.�� >>> 6.302-1 Only one responsible source and no other supplies or services will satisfy agency requirements.� This action is made using sole source procedures under FAR subpart 13.5 and in accordance with 41 U.S.C.1901. � 5.� A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority. >>> BARRACUDA VIRTUAL REACTOR is unique among CFD technologies because it is designed exclusively for one purpose: to model particulate-solid flows in fluidized systems.� Unlike familiar codes such as ANSYS Fluent, CD-Adapco STAR-CCMT, Open Foam and others who gradually modified single-phase CFD methods to model particle flows, the Barracuda engineering software package was built from the ground up, based on the firm foundation of the multiphase-particle-in cell (MP-PIC) description of the particle phase with strong coupling between fluid and particle phases.� As a result, it delivers and unequaled level of accuracy that translates to economic value and a competitive advantage when it comes to: Avoiding costly reactor shutdowns and repairs Lengthening equipment life cycles Increase production of reactor products and yields Reducing emissions Ensuring success of scale-up operations Predicting performance without prototype investment 6.� A description of efforts to ensure that offers were solicited from as many potential sources as is practicable.� Include whether or not a FedBizOpps announcement was made and what response, if any, was received, and include the exception under FAR 5.202 when not synopsizing.� Describe whether any additional or similar requirements are anticipated in the future.� (This may not be included as an addendum, but must be in the body of the JOFOC.) >>> A special notice will be posted to Beta.Sam in accordance with FAR 5.202 procedures and to Fedconnect.� No responses of applicable cabability were received as a result of the Notice of Intent which closed at 4:00pm (ET) on 12/29/2020.� An internet search was also performed and did not identify other resellers of the BARRACUDA VIRTUAL REACTOR software licenses. 7.� Cite the anticipated dollar value of the proposed acquisition including options if applicable and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. � >>> The total contract value is anticipated to be $257,500.00. � 8.� A description of the market research conducted and the results or a statement of the reason market research was not conducted.� Do not simply refer to the sources sought synopsis. >>>� CPFD LLC. confirmed that they are the developer and sole provider of the BARRACUDA VIRTUAL REACTOR engineering software.� A world wide web search was conducted on and no other vendors were located that offered the BARRACUDA VIRTUAL REACTOR engineering software. 9.� Any other facts supporting the use of other than full and open competition, such as: a.� Explanation of why technical data packages, specifications, engineering descriptions, statements of work or purchase descriptions suitable for full and open competition have not been developed or are not available.� �>>>� None b.� When FAR Subpart 6.302-2 is cited for follow on acquisition as described in FAR 6.302-1(a)(2)(ii), an estimate of cost to the Government that would be duplicated and how the estimate was derived. >>>� None c.� When FAR 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government.� >>> None � �� 10.� A listing of the sources, if any, that expressed a written interest in the acquisition. >>>� As of the posting response date of December 29, 2020; no other interested parties with applicable capabilities responded or expressed an interest in this acquisition. 11.� A statement of actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated. >>> NETL shall monitor to see if different sources and capabilities are available for future efforts.
