- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health, Eunice Kennedy Shriver National Institute of Child Health and Human Development (NICHD), Office of Acquisitions (OA) on behalf of the on behalf of the National Institute of Digestive, Diabetes & Kidney Diseases intends to award a purchase order without providing for full and open competition (Including brand-name) to BECTON, DICKINSON AND COMPANY for the purchase of a Service Contract for BD Symphony A5 and one BD FACStation. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 811219 with a Size Standard of $22.0. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through Federal Acquisition Circular 2021-02 effective November 23, 2020. This acquisition is conducted under the procedures as prescribed in FAR subpart 13�Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000). STATUTORY AUTHORITY This acquisition is conducted under the authority of 41 U.S.C. 253(c) under provisions of the statutory authority of FAR Subpart 6.302- FAR 6.302-1�Only one responsible source and no other supplies or services will satisfy agency requirements 41 U.S.C. 253(c)(1). DESCRIPTION OF REQUIREMENT The National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK) conducts and supports research on many of the most serious diseases affecting public health. The Institute supports much of the clinical research on the diseases of internal medicine and related subspecialty fields, as well as many basic science disciplines.� The Institute's Division of Intramural Research encompasses the broad spectrum of metabolic diseases such as diabetes, obesity, inborn errors of metabolism, endocrine disorders, mineral metabolism, digestive and liver diseases, nutrition, urology and renal disease, and hematology. Basic research studies include biochemistry, biophysics, nutrition, pathology, histochemistry, bioorganic chemistry, physical chemistry, chemical and molecular biology, and pharmacology.� NIDDK extramural research is organized into 4 divisions: Diabetes, Endocrinology, and Metabolic Diseases; Digestive Diseases and Nutrition; Kidney, Urologic, and Hematologic Diseases; and Extramural Activities. �The Institute supports basic and clinical research through investigator-initiated grants, program project and center grants, and career development and training awards. The Institute also supports research and development projects and large-scale clinical trials through contracts. _________________________ The Liver Diseases Branch at the National Institutes of Health (NIH) National Institute of Diabetes and Digestive and Kidney Diseases (NIDDK) has a requirement to obtain services to maintain the operation of BD FACSymphony A5 (Serial# : R6609640006) with FACS Flow Supply System (Serial# : N3492775343), OBIS 405-200 LX Violet Laser, OBIS 637-140 LX Red Laser, G4 355-60 w/BD UV Laser, Cohr Sapphire 532-200 Laser and OBIS 488-150 LX Blue Laser. The instrument needs regular preventive maintenance and software updates thereafter. �The instrument is used by the Liver Diseases Branch to study by flow cytometry clinical samples of patients who are followed in in clinical protocols. �It is therefore necessary to have a short response time of service engineers who are experts on this custom-built instrument, should the instrument need fine-adjustments (e.g. if the lasers moved slightly), cleaning (e.g. if the fluidics or flow cell are blocked) or repair. PURPOSE AND OBJECTIVES To provide maintenance and service for the BD FACSymphony A5 instrument and FACS Flow Supply System that are used by the Liver Diseases Branch to study by flow cytometry clinical samples of patients who are followed in in clinical protocols. �It is therefore necessary to have a short response time of service engineers, should the instrument need fine-adjustments (e.g. if the lasers moved slightly), cleaning (e.g. if the fluidics or flow cell are blocked) or repair. Base plus Four Option Years SALIENT / REQUIRED FEATURES AND SPECIFICATIONS Specifically, the NIDDK requires the following: 1.�� �Provide a qualified technician to perform service on the BD Symphony A5 and one BD FACStation for �� �two (2) Preventive Maintenance Inspections during a twelve-month period.� 2.�� �Provide unlimited service visits Monday through Friday 8:00 AM to 5:00 PM during the term of this agreement, excluding holidays. 3.�� �Provide emergency on-site service within 48 hours if the call for service occurs Monday through Friday, excluding holidays. If vendor fails to meet this commitment, a $500.00 Response Time Credit shall be issued. 4.�� �Unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. 5.�� �Cover the FACS Flow Supply System for labor, travel expenses and parts (excluding consumables) for the following:� - Unlimited service visits, Monday through Friday, excluding BD Biosciences holidays. - Unlimited telephone support for instruments, reagents and applications will be provided at no additional charge. 6.�� �The following lasers are included in the service contract: OBIS 405-200 LX Violet Laser; OBIS 637-140 LX �� �Red Laser; G4 355-60 w/BD UV Laser; Cohr Sapphire 532-200 Laser; OBIS 488-150 LX Blue Laser. 7.�� �Two (2) PM Kits will be provided and Software Revisions that are released during the Agreement term CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10�Market Research. �Only one source is available: Per FAR 13.106-1(b)(1) the Contracting Officer has determined BECTON, DICKINSON AND COMPANY to be the only reasonable available source to provide a Service Contract for BD Symphony A5 and one BD FACStation. �� This acquisition was pursued on a sole source basis centered on the BD FACSymphony A5 being custom-built with a customized laser/filter combination according to the flow cytometry needs of the Liver Diseases Branch, NIDDK, NIH. BD Biosciences has made further custom modifications on both hardware and software on the BD FACSymphony A5 during the warranty period. �Because BD Biosciences is the manufacturer of this instrument, it is better suited than other service agreement vendors to trouble-shoot and fine-adjust the instrument to the research needs. � BD Biosciences is also the sole source for any replacement part should the instrument need repair. �The instrument is used by the Liver Diseases Branch to study by flow cytometry clinical samples of patients who are followed in in clinical protocols. �It is therefore necessary to have a short response time of service engineers with high level of expertise for this custom-built instrument, should the instrument need fine-adjustments (e.g. if the lasers moved slightly), cleaning (e.g. if the fluidics or flow cell are blocked) or repair. � BD Biosciences is the manufacturer and sole authorized service provider for this instrument. BD Biosciences possesses all the required parts, documents and schematics necessary to service the NIDDK�s instruments to ensure that they are maintained at design specifications. In addition, only BD Biosciences provides instrument software revisions. These are installed by BD Field Service Engineers and are associated with optimizing instrument performance. BD Biosciences does not certify third parties either to service its instruments or to distribute the necessary parts for repair. �Furthermore, instrument service on a routine basis is critical to maintain the accuracy and capability of the equipment, which is used by members of the NIDDK Liver Diseases Branch. This practice of execution of a service contract is not common and is impossible to replicate using a 3rd party vendor because of problems of accounting and the need to avoid conflicts of interest involved. Although there are vendors who may claim that they provide service contracts for the NIDDK�s instruments, the reality of execution of these so called service contracts, though having the same ultimate deliverable (working instruments) do not have a level of performance close enough to that provided by the current vendor that they could be called comparable. This difference is not a question of competence or good will just a fundamental issue with the business model of 3rd party providers. No third-party contract managers will be considered due to the difference in repair caps, and delays for approvals over pre-designated dollar thresholds. Failure to procure preventative maintenance for these systems from BECTON, DICKINSON AND COMPANY would result in a significant loss of research. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties� bona-fide capabilities for fulfilling the requirement and include: descriptive literature, delivery timeframe, warranties and/or other information that demonstrates that the offer meets all the foregoing requirements, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov.� A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.
