- The Consumer Financial Protection Bureau (CFPB) intends to contract with AgileLaw, LLC, 10900 Research Blvd # 160C-4, Austin, TX 78759, on a sole source basis, under authority of FAR 6.302-1, for AgileLaw�s exhibit sharing application.�AgileLaw, LLC has been identified as the only source capable of providing the required application. Due to the Covid-19 pandemic, the Bureau has disallowed staff from undertaking travel for official business. Additionally, most law firms that the Bureau has engaged with are also unable to travel. Despite this halt in travel, investigational hearings and depositions continue but are being conducted via remote video using a teleconferencing platform that is not designed for exhibit sharing.� The Bureau requires an exhibit sharing application that meets certain criteria including the ability to for Bureau staff to upload documents, control the timing of sharing of those documents with a witness and opposing counsel and provide the ability for the witness and opposing counsel to independently review the document once shared. In addition, when sharing exhibits that are Microsoft Excel files, it must be able to do so natively so that the opposing party can review the content of cells, rearrange columns, and manipulate any sheets. A static view of an Excel file is not sufficient. Further, for investigational hearings the application must not allow the opposing party to download and keep a copy of any exhibit. The Bureau must be able to maintain control of exhibits at all times. T&I and Enforcement have conducted market research to examine the features of a number of off-the-shelf exhibit sharing applications. The market research was conducted over the month of August during which I began in-depth analysis of the four products. The following products were identified as candidates that may have met requirements outlined by our Enforcement and Legal divisions. Live Litigation Veritext Exhibit Share eDepoze AgileLaw Live Litigation was removed from eligibility based on Cybersecurity concerns as the service was built on Adobe Flash which is at end-of-life and will not receive future security updates. Veritext Exhibit Share lacks several functionalities outlined in the requirements. eDepoze met most of the requirements but it does not support two critical criteria: native Excel document rendering and security options that can restrict which participants can download presented documents. All criteria were exclusively met by the AgileLaw product. Currently, the AgileLaw application is the only one which meets all of the Bureau�s requirements. No solicitation package will be issued. This notice is NOT a request for competitive quotations; however, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency.� The Government will consider responses received by January 20, 2021 @ 2 pm est. NO SOLICITATION IS AVAILABLE. A request for more information or a copy of the solicitation will not be considered an affirmation response to the Special Notice. Telephone responses or inquires to this Special Notice will NOT be accepted. Responses shall be submitted electronically to Corey.Wright@cfpb.gov AND Jerry.Salinas@cfpb.gov.� Responses must include sufficient evidence that clearly demonstrates the vendor is available and is capable of providing the required services. If no written response is received that clearly demonstrates an ability to meet all requirements, is more advantageous to the Government, and is received by the aforementioned deadline, CFPB shall make award on a sole source basis to AgileLaw, LLC. Responses shall provide, at a minimum, the following: 1. Company name and address, contact information, DUNS Number, and business size (Large Business, Small Business, Disadvantaged Business, 8(a), Service Disabled Veteran Owned Small Business, HUBZone, etc.). Please ensure contact information includes the name of the point of contact, email address, and telephone number should the Government have questions regarding individual responses. 2. Whether your services are available through a Government contract vehicle or Open Market. 3. A brief capabilities statement (not to exceed 5 pages) that includes a description of your company's standard line of business, methodology for exhibit sharing, your proposed professional services, as well as a list of customers for which your company currently provides these services. This notice does not restrict the Government to an ultimate acquisition approach. All firms responding to this notice are advised that their response is not a request that will be considered for contract award. All interested parties will be required to respond to any resultant solicitation separately from their response to this notice. A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
