- Page 2 of 2 DEPARTMENT OF VETERANS AFFAIRS Justification for Sole Source Awards IAW FAR 13.106-1(b) For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K) Acquisition Plan Action ID: 36C252-21-AP-1294 & 36C252-21-AP-1296 Contracting Activity: Department of Veterans Affairs Great Lakes Acquisition Center, NCO-12 115 South 84th Street, Suite 101 Milwaukee, WI 53214-1476 Department of Veterans Affairs Jesse Brown VA Medical Center 2030 West Taylor Chicago, IL 60612-4223 Identify purchase request number: 537-21-2-969-0096 Brief Description of Supplies/ Services required and the intended use/Estimated Amount: Jesse Brown VA Medical Center located in Chicago, Illinois has an Urgent sole source request for Transducers and Reprocessing Trays that will be utilized by Urology Clinic/Operating Room to treat patients requiring prostate biopsy procedures. Estimated Amount: $X.XX Unique characteristics that limit availability to only one brand, with the reason no other supplies or services can be used: Current Genitourinary (GU) ambulatory procedure room inventory of the 8818 Prostate Triplane Transducer Model has 10 probes. These ultrasound probes are used for prostate biopsy procedures. On an averaged at least three-four out of the 10 probes are being sent for repair leaving only six probes on average that are available for use which are also being turned over after each use by the Sterile Processing Service (SPS) on an average of two hours. GU ambulatory performs five-seven prostate biopsy cases on average daily. By adding five more scopes to the inventory from 10-15, GU ambulatory will have sufficient probes available to support the number of procedures being done on a daily basis without waiting for SPS to turn over the sterile probes. This will also reduce the delay and cancellation of procedures due to probe availability. As of January 8, 2021, there are only four functional probes available for use due to aged equipment and two probes are deemed beyond repair and need to be replaced. Description of market research conducted and results or statement why it was not conducted: Original Equipment Manufacturer (OEM) for this requirement is BK Medical Holding Company, Inc. who is considered an other than small business (OTSB) per System for Award Management (SAM) Reps & Certs. Furthermore, BK Medical Holding Company, Inc. also does business under Analogic Corporation who is also an OTSB per SAM Reps & Certs. The appropriate North American Industry Classification System (NAICS) for this requirement is 334510 (Electromedical and Electrotherapeutic Apparatus Manufacturing), with a Small Business Size Standard of 1,250 Employees. The corresponding Federal Supply Code (FSC) is 6525 (Imaging Equipment and Supplies: Medical, Dental, Veterinary). Market research indicates that this procurement shall be sole source to OEM for unusual and compelling urgency open market in order to replace broken equipment IAW 41 USC § 3304(a)(2), FAR 6.302-2, and FAR 13.106-1(b).
