Contracting Office Address Department of Health and Human Services, National Institutes of Health, National Cancer Institute, Office of Acquisitions, 9609 Medical Center Drive, Room 1E156 Bethesda, MD 20892, UNITED STATES DESCRIPTION � The U.S. Department of Health and Human Services (DHHS), National Institutes of Health (NIH), National Cancer Institute (NCI), Center for Cancer Research (CCR), Cancer Genetics Branch (CGB), Genomics core intends to procure preventive maintenance support services on a sole source basis from Bio-Rad Laboratories at 2000 Alfred Nobel Drive, Hercules, California 94547 This procurement is being conducted using commercial item procedures pursuant to FAR Part 12 and FAR Part 13, specifically FAR Subpart13.106-1(b)(1)(i) allowing the Contracting Officer (CO) to solicit from one source.� Only one award will be made as a result of this solicitation. This will be awarded as a Severable Firm-fixed price type contract with four option periods. � It has been determined there are no opportunities to acquire green products or services for this procurement. BACKGROUND The Department of Health and Human Services (DHHS), National Institute of Health (NIH), National Cancer Institute (NCI), Center for Cancer Research (CCR), Laboratory of Receptor Biology and Gene Expression (LRBGE) requires preventative maintenance services for a government owned Bio Rad equipment. The LRGBE elucidates the mechanisms involved in the regulation of genetic expression in eukaryotic cells and identifies the genes and regulatory processes involved in modulated states of expression during oncogenesis. In order to do so, specialized equipment is needed to tease out the organization of chromatin. The equipment covered under this acquisition has been purchased over many years and requires emergency service for it to function when something goes wrong with it. OBJECTIVE The purpose of this acquisition is to procure maintenance support service for LRBGE Bio-Rad equipment to minimize down-time when equipment is malfunctioning. This acquisition will require the Contractor to provide unlimited on-site repair visits, including parts, labor and travel expenses, during the service agreement coverage period. Two items are noted for mail in service. SCOPE The Contractor shall provide all labor, travel, material, parts and equipment to provide unlimited repair for government-owned equipment for the period of performance listed: See the attached document for equipment listing. All service shall be performed in accordance with the manufacturer�s standard commercial maintenance practices.� TYPE OF ORDER This will be issued as a severable firm fixed price purchase order.� CONTRACT REQUIREMENTS EMERGENCY SERVICE Emergency repair services shall be provided: unlimited on-site repair visits, including parts, labor and travel expenses, during the service agreement coverage period at no additional cost to the government. Emergency service shall be provided during normal working hours, Monday thru Friday excluding Federal Holidays. Upon receipt of notice that any part of the equipment is malfunctioning the Contractor shall within one business day provide a qualified factory-trained service representative to inspect the malfunctioning equipment and perform all necessary repairs and adjustments to restore said equipment to normal operating condition. Emergency service calls shall not replace the necessity for scheduled preventive maintenance. The contractor shall provide a technical support hot-line number for telephonic trouble shooting during normal working hours. PC coverage is not included. In the event of necessary PC service, reinstallation of Bio-Rad provided software and PC re-configuration is covered by this agreement. For mail in contract equipment, Contractor shall provide appropriate boxes for shipping equipment to the contractor for service. REPLACEMENT PARTS � The Contractor shall furnish all required replacement part at no additional cost to the Government, with the exception of consumable parts. Parts shall be new or remanufactured to original equipment specifications. These parts shall be delivered the next day or as soon as possible. SOFTWARE UPDATES/SERVICE � The Contractor shall provide Software Service in accordance with the manufacturer�s latest established service procedures, to include telephone access to technical support for program software issues and operating systems troubleshooting, at no additional cost to the Government. The Contractor shall receive advance approval for the installation of all software updates and revisions from the Government. Defective software shall be replaced at no additional cost to the government. SERVICE EXCLUSIONS The Contractor shall not be responsible for any repairs necessitated by abuse, neglect, vandalism, Acts of God, fire or water. These repairs shall be the subject of a separate purchase order and shall not be performed under this contract. PERIOD OF PERFORMANCE This award shall have a base period of twelve (12) months with four twelve (12) month option periods. Base Period: August 1, 2021 to July 31, 2022 Option Period 1: August 1, 2022 to July 31, 2023 Option Period 2: August 1, 2023 to July 31, 2024 Option Period 3: August 1, 2024 to July 31, 2025 Option Period 4: August 1, 2025 to July 31, 2026 PLACE OF PERFORMANCE Onsite services shall be performed at the following location: ����������� LRBGE ����������� BLDG 41 ����������� NIH, NCI ����������� 41 MEDLARS Dr ����������� Bethesda, MD 20892 This notice is not a request for competitive quotation. However, if any interested party, especially small businesses, believes it can meet the above requirement, it may submit a capability statement, proposal, or quotation, which shall be considered by the agency.� The statement of capabilities and any other information furnished must be in writing and must contain material in sufficient detail to allow NCI to determine if the party can perform the requirement.� Responses must be received in the contracting office by 12:00 PM EST on February 1, 2021.� All responses and questions must be emailed to Elizabeth Tucker, Contract Specialist via electronic mail at elizabeth.tucker@nih.gov. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. No collect calls will be accepted. In order to receive an award, contractors must be registered and have valid certification in the System for Award Management (SAM) through sam.gov.
