Description
This action is for the award of a sole source firm-fixed priced Indefinite Delivery/Indefinite Quantity (IDIQ) contract to Conflict Kinetics Corporation, 22977 Eaglewood CT STE 160, Sterling VA 201669448 utilizing the authority of Other Than Full and Open Competition as permitted by 10 U.S.C. 2304(c)(1), and implemented by FAR 6.302-1, since there is only one responsible source and no other supplies or services will satisfy agency requirements. The proposed acquisition is for the procurement of Small Arms Simulator support services to include: on-site hardware, software and contracted information technology (IT) system security, air compressors, replacement equipment (such as weapons, cameras, CPUs, etc.), and software modifications/software warranty as needed to maintain training simulator support for all NECC Conflicts Kinetics TORA simulators, located in various NECC CONUS locations and at Conflicts Kinetics Corporations.The statutory authority permitting Other Than Full and Open Competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, since there is only one responsible source and no other supplies or services will satisfy agency requirements. The authority FAR 6.302-1 cited in paragraph 4 above is applicable because the Government�s need can only be satisfied by the current contractor and Original Equipment Manufacturer (OEM), Conflict Kinetics Corporation. The TORA Weapons Simulators owned by NECC were manufactured by Conflict Kinetics Corporation and are not compatible with other manufacturers� simulators. Conflict Kinetics Corporation has proprietary rights to their equipment, hardware and software, eliminating support from other vendors. The Government has conducted extensive market research since 2012 for the Navy Category III/IV marksmanship training simulator requirement. Most recently, in March 2020, the NAVSUP FLC Norfolk Contracting Department issued a Sources Sought Notice in accordance with DFARS PGI 206.302-1. Capability statements were received from the incumbent, Conflict Kinetics, and three (3) additional vendors: Thomas Solutions, Inc., Oak Grove Technologies, and Industrial Smoke and Mirrors. Thomas Solutions did not discuss their ability to maintain weapons simulators or access to Conflict Kinetics� proprietary software or data rights for the TORA Weapons Simulators. Oak Grove Technologies proposed a replacement simulator weapons system and did not state they had access to the TORA software or data rights. Finally, Industrial Smoke and Mirrors proposed to replace the weapons and software on NECC�s existing simulator base; however, the proposed simulator program, Virtual Battle Space (VBS), does not offer the fidelity of marksmanship necessary to qualify students for Navy Category III/IV marksmanship. Although this market research revealed similar weapons simulators and related services are available from other commercial manufacturers, these systems and services are not compatible with the TORA Weapons Simulators nor can these manufacturers offer services on NECC�s existing simulators due to proprietary rights.Market research confirmed Conflict Kinetics is the sole manufacturer of the TORA Weapons Simulators, ancillary equipment and hardware, and software, and there are no authorized re-sellers or service providers. Purchasing weapons simulator product offerings other than TORA would entail a 100% new buy-in scenario and represents a significant duplication of expenses to replace NECC�s entire simulator weapons inventory and associated ancillary equipment. This represents a substantial duplication of cost to the Government that is not expected to be recovered through competition.
