Description
INTENT TO SOLE SOURCE Debtwire US Restructuring Data (Annual Subscription) #SS-OFR-21-043 The Bureau of Fiscal Service (Fiscal Service), on behalf of The Office of Financial Research (OFR) and the Financial Stability Oversight Council (FSOC), intends to contract with Mergermarket US Ltd., dba Debtwire.com (Acuris), 1501 Broadway F1 8 , New York, NY, 10036-5601,� on a sole source basis. There is no competitive vendor or regulatory agency that provides these datasets. The proposed Contractor developed and owns the propriety and patented hardware, software and algorithms that are used in these products and support the services specifically required for this acquisition; thereby the proposed source has the sole unique technical and other resources required for this acquisition. The Office of Financial Research (OFR), on behalf of the Financial Stability Oversight Council (FSOC), is pursuing subscription data access to US corporate financial restructuring data and relevant analytic data covering US distressed and bankruptcy markets with over $100M in funded debt, updated at least monthly. OFR Research and Analysis requires searchable access to Debtor In Possession (DIP) financial information to analyze aggregate DIP financing by sector and company size.� At present OFR does not have access to such data via existing databases under contract or in-house.� In addition, data is requested that covers every type of bankruptcy event with relevant research and analysis (such as news, credit research, legal analysis, and court coverage) via a searchable data feed for US distressed and bankruptcy markets with over $100M in funded debt, updated at least monthly.� Access to this information will enable RAC to monitor events and trends indicative of future business liquidations which may present adverse consequences for U.S. financial stability.� Data should be made available via an FTP feed as well as web portal access for unlimited in-house users for one year, including optional years of access where available. The data must minimally include: Searchable data covering US corporate financial restructuring data and high yield/unrated, stressed, distressed, and bankrupt companies in the US and Canada with funded debt greater than $150M USD.� Track all Chapter 11, Chapter 7, and Chapter 15 cases, advisors, creditors, and transactions from US Corporate bankruptcies valued over $10M with historical coverage from January 2016.� Data includes searchable Debtor In Possession (DIP) and Rights Offerings, exportable into Microsoft Excel.� Search can be filtered by cases, advisors, and creditors connected to each case. Editorial coverage, research, legal analysis, and court coverage for high yield/unrated, stressed, distressed, and bankrupt companies in the US and Canada with funded debt greater than $150M USD.� Access to this subscription includes monthly report highlights for bonds and loans of levered borrowers, weekly reports for bonds and loan pricing quotes within the covered financial area, and additional highlights indicative of near term default events.� Availability of in-depth reports for company business models, making projections, and waterfall recovery for creditors. The OFR plans to use this product for the continuing mission to support the Financial Stability Oversight Council (�the Council�) in promoting� financial stability by: collecting data on behalf of the Council; providing such data to the Council and member agencies; standardizing the types and formats of data reported and collected; performing applied research and essential long-term research; developing tools for risk measurement and monitoring; performing other related services; making the results of the activities of the OFR available to financial regulatory agencies; and assisting such member agencies in determining the types of formats of data authorized by Dodd-Frank Act to be collected by such member agencies. The period of performance for the purchase order is anticipated to be one 12-month base period with four 12-month options. The total estimated value of this purchase order will not exceed the simplified acquisition threshold. NO SOLICITATION IS AVAILABLE.� A request for more information, or a copy of the solicitation, will not be considered an affirmative response to this Special Notice. Telephone responses or inquiries to this Special Notice will not be accepted. Fiscal Service will consider written responses received no later than 02/17/2021.� Responses must be submitted electronically to purchasing@fiscal.treasury.gov, Corporate Hierarchy /Attn: RJ � JJ. Responses must include sufficient evidence that clearly shows your company is capable of providing the content described in this notice. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no written response is received by the aforementioned deadline that clearly demonstrates an ability to meet all requirements, and that is more advantageous to the Government, Fiscal Service will make award on a sole source basis to Debtwire.com (Acuris), Qualified Contractors must provide the following: 1. The name and location of your company, contact information, and identify your business size (Large Business, Small Business, Disadvantaged Business, 8(a), Service Disabled Veteran Owned Small Business, HUBZone, etc.).� Please ensure contact information includes the name of the point of contact, email address, and telephone number, should the Government have questions regarding individual responses. 2. DUNS Number. 3. Specific details of the product(s) that your company offers in regard to this notice. 4. Whether your content is available through a Government contract vehicle or Open Market. 5. A brief capabilities statement (not to exceed 5 pages) that includes a description of your company's standard line of business, as well as a list of customers to whom your company currently provides the specific required content. The following file extensions are not allowable and application materials/data submitted with these extensions cannot be considered: .bat, .cmd, .com, .exe, .pif, .rar, .scr, .vbs, .hta, .cpl, and .zip files. Microsoft Office and Adobe compatible documents are acceptable. No other information regarding this Special Notice will be provided at this time. The period of performance for this action is to be one (1) twelve-month base period with four (4) 12-month option periods after receipt of order (ARO).� Fiscal Service may consider information received no later than 12:00 p.m. EST on Thursday, February 17, 2021, submitted to purchasing@fiscal.treasury.gov, OpenCorporates / Attn: RJ - JJ.
