Description: NOTICE FOR FILING AGENCY PROTESTS �� United States Coast Guard Ombudsman Program It is the policy of the United States Coast Guard to issue solicitations and make contract awards in a fair and timely manner. Parties who believe a specific procurement is unfair or otherwise defective are encouraged to use the Coast Guard Ombudsman Program for Agency Protests (OPAP), rather than filing a protest with the Government Accountability Office (GAO) or other external forum. The OPAP is designed to resolve contractor protests in a faster, less expensive manner. Concerns of interested parties can be resolved through independent, government binding adjudication taking place outside the procuring activity's chain of command. How do I file an agency protest? Interested parties may seek resolution of their concerns informally or opt to file a formal agency protest with the contracting officer or Ombudsman. Informal Forum Interested parties should first direct their concerns to the responsible contracting officer. If the contracting officer is unable to satisfy the concerns, the interested party is encouraged to contact the OPAP. Under this informal process, the agency is not required to suspend contract award performance. In order to ensure a timely response, interested parties should provide the following information: solicitation/contract number, contracting office, contracting officer, and solicitation closing date (if applicable). Formal Agency Protest Prior to submitting a formal agency protest, protesters must first use their best efforts to resolve their concerns with the contracting officer through open and frank discussions. If the protester�s concerns are unresolved, the protester may file a formal agency protest with the contracting officer or the OPAP program. Contract award or performance will be suspended during the protest period unless contract award or performance is justified, in writing, for urgent and compelling reasons or is determined to be in the best interest of the government. The agency�s goal is to resolve protests in less than 35 calendar days from the date of filing. If the protester fails to submit the required information, as outlined in Federal Acquisition Regulation (FAR) 33.103, resolution of the protest may be delayed or the protest may be dismissed. Are you able to store two 32� TPSB�s in a secured location, whether it be indoors or in an outside/fenced location?� If outdoors, are you able to cover the boats during inclement weather? Does your company have experience working with Maintenance Procedure Cards? Contractor shall provide a Quality Control Plan that sufficiently addresses Section 3.6 of the PWS. �� PAST PERFORMANCE The Offeror shall submit up to three (3) examples of past performance similar in size, scope and technical difficulty to this solicitation, which will be evaluated to determine the likelihood of successful performance, and shall be limited to 1 page for each submission.� The following information shall be included with each past performance submission: Name of Customer, Detailed description of services performed, Period of Performance, Total Dollar Value of work performed by your company and PoC Information of Customer, to include name, phone number and email address.� The Government�s evaluation of the Offeror�s Past Performance shall be a subjective assessment based on consideration of all relevant facts and circumstances concerning an Offeror�s Past Performance. �Past Performance will be reviewed for relevancy to the Performance Work Statement requirements, to include all previous repair work performed on the 32� TPSB or any small boat under 65� in length, as well as quality of services rendered/deliverables provided. The Government reserves the right to review the Offeror�s past performance not only on those projects/programs presented by the Offeror, but also through information obtained from other sources available such as publicly available reports or data from the Past Performance Information Retrieval System (PPIRS).� The information gathered for Past Performance may also be used in the responsibility determination.� The Government will review all Past Performance data submitted with the proposal and may contact all referenced companies/organizations listed or other sources to verify Past Performance information. Offerors without a record of relevant Past Performance or for whom information on past performance is not available, shall receive a neutral rating.� If that is the case, Offerors shall submit a certification to the Contracting Officer asserting that they have no directly related or relevant Past Performance experience. An evaluation rating of Acceptable/Not-Acceptable will be assigned upon completion of the past performance evaluation.� If an Offeror receives a past performance rating of �Not-Acceptable� they will not be considered for award. The Government will also review the Offeror�s Past Performance record of performance in the Federal Awardee Performance and Integrity Information System (FAPIIS) system for those projects that are similar in nature, size and complexity as this requirement, performed or completed within the past five years.
