SPECIAL NOTICE NEGOTIATION A SOLE-SOURCE CONTRACT � SINGLE SOURCE DETERMINATION USING SIMPLIFIED ACQUISITION PROCEDURES (SAP) FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD (AUTHORITY: FAR 13.106-1(b)(1)) Agency and contracting activity. Department of Commerce, NOAA Office of Marine and Aviation Operations, Acquisition, Analysis, and Accountability Branch. Description of supplies or services required to meet agency needs. This specification contains requirements for procuring anodes for the NOAA Ship Gordon Gunter. Procure copper anodes, Elinca Part No. EL40012-9.� There are NO �OR EQUAL� and Procure iron anodes, Elinca Part No. EL40014-9.� There are NO �OR EQUAL� Identification of the single source or the brand name to be solicited. Admiral Filter Company LLC 18 Green Pond Rd Ste 3 Rockaway, NJ 07866, DUNS:829193049 Supporting rationale. Only one source or brand name is reasonably available as detailed below: Brand Name � Compatibility to existing systems or equipment - The current system is no longer in production and there is only one Original Equipment Manufacturer (OEM) Factory Authorized Representative in the USA. Given the age of the system and need to prevent sea growth buildup in the sea water suction, this system needs to be maintained to the full factory standards. Replacing the system is costly while this system has parts and services available through the single vendor. We replace these parts during the vessel scheduled dry dock periods to ensure optimum performance between dry docks. � The North American Industry Classification Code (NAICS) for this acquisition is 332999 All Other Miscellaneous Fabricated Metal Product Manufacturing; the small business size standard is 750 Employees Deliver the anodes to the following address: NOAA Ship Gordon Gunter Gulf Marine Support Facility 151 Watts Ave Pascagoula, MS 39567 The Government is not aware of any other vendors that are authorized to provide, service, or support this request, without compromising OEM, propriety, warranty, delivery, or additional markups. The Government intends to acquire these parts under the guidelines of FAR Part 13, Simplified Acquisitions Procedures and FAR Part 12, Commercial Items. The Government intends to solicit and negotiate directly with admiral Filter Company, under the authority of FAR 13.106-1(b)(1)(i). This is not a solicitation for competitive quotes. However, if any authorized party that can provide this subscription/licensing without compromising manufacturing delivery or mark ups may submit a statement of capabilities, which if in timely received, will be considered by NOAA OMAO. A statement of capabilities to include the detailed service including manufacture authorization, and OEM agreement, and a price list, this shall be received by 08:00 AM EST on 20 February 2021. A determination by the Government not to compete this proposed requirement is based upon responses to this notice and it is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of the required service while also be authorized by the manufacture. The capability statement, a price list and any other information furnished must be in writing and must contain material in sufficient detail to allow the Government to determine if the party can meet all of the system requirements. Capability statements and related materials must be e-mailed to Christopher Baker at Christopher.Baker@noaa.gov by 08:00 AM EST on 20 February 2021.
