Description
The National Institute of Standards and Technology (NIST) intends to negotiate on a sole source basis under the authority of FAR 13.106-1(b)(1) Soliciting from a Single Source, with DataWorks Development, Inc., Mountlake Terrace, WA for the purpose of renewing the annual Customer Care Program for the NIST Charleston Biorepository�s perpetual license of Freezerworks Summit Ed. sample management software.� The Customer Care Program includes maintenance releases, software upgrades and unlimited technical support. This is a sole source inasmuch as DataWorks Development, Inc.:� a) is the author, exclusive owner, and sole provider of all Freezerworks laboratory database products; b) is the only organization worldwide with the unique technical competence, expertise, and proprietary technology used in the manufacture and application of Freezerworks; and, c) maintains all intellectual property rights through copyright and trademark privileges.� Maintenance services for Freezerworks products must be obtained directly from the OEM.� Furthermore, the metadata and storage location information has been manually entered over many years into the Freezerworks database for +100,000 biological and environmental samples located at the NIST Charleston Biorepository. A firm fixed-price purchase order will be negotiated and issued on or about 26 Mar 2021 for a 12-mo. period and include (4) 12-mo. option periods to cover renewal of maintenance and support associated with the Freezerworks Customer Care Program.� No solicitation package will be issued.� This notice is not a request for competitive quotations; however, interested parties may identify their interest and capability to respond to the requirement.� Inquiries will only be accepted via e-mail to randy.schroyer@nist.gov.� The government will consider responses received by 5:00PM, EST, 1 Mar 2021.� Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill the requirement.� A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.� Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.� This notice of intent is not a Request for Quotation (RFQ) nor is it a request for competition.� No telephone requests will be honored.
