VHAPM Part 806.3 Other Than Full and Open Competition (OFOC) SOP RPO-W Tracker#: Attachment 2: Request for Sole Source Justification >SAT 2020-12-18T07:13:35 OFOC SOP Revision 10 Page 1 of 9 Original Date: 03/22/11 Revision 10 Date: 09/10/2020 DEPARTMENT OF VETERANS AFFAIRS Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT) Acquisition Plan Action ID: 36C257-20-AP-4130 Agency: Department of Veterans Affairs (VA) Contracting Activity: Network Contracting Office 17 (NCO-17) 6010 Amarillo Blvd W Amarillo, TX 79106 Nature and/or Description of the Action Being Processed: NCO-17 intends to award a new firm-fixed price (FFP) contract for a base plus four years license agreement with Alere informatics for the RALS (RALSWeb3) data management system. The contract will be for a base year with the potential of four option years as follows: Base Performance Period: 02/01/2021 01/31/2022 Option Period 1: 02/01/2022 01/31/2023 Option Period 2: 02/01/2023 01/31/2024 Option Period 3: 02/01/2024 01/31/2025 Option Period 4: 02/01/2025 01/31/2026 Option periods may or may not be exercised based on the customer s need. Description of Supplies/Services Required to Meet the Agency s Needs: This requirement is for the procurement a base plus four years license, install, service, and maintenance agreement for the RALS Web3 device software module for the Roche Accu-Chek Inform II Glucometers, Roche CoaguChek XS Plus meters, Quidel Sofia, Abbott ID NOW, Clinitek Status + and Medtox analyzers. This system enhances patient care by placing the patient results in their electronic permanent record without delay. The RALS interface also enhances the El Paso VA lab s ability to identify patient identification errors in a timely manner. This data management system captures data and generates reports which will enable the lab to meet the requirements of regulatory agencies (VA, CAP, The Joint Commission and CLIA). The only known contractor that can provide the RALS Web3 computer software interface and service agreement is Abbott Rapid Diagnostics Informatics, Inc. (Abbott), who is a Large Business. Additionally, the RALS Web3 system is needed as it is compatible with current equipment and systems. The estimated value of the services is REDACTED for the base year, and REDACTED for the base year plus four option years. The period of performance for the base plus four years is January 1, 2021 through December 31, 2025. Statutory Authority Permitting Other than Full and Open Competition: (X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1; ( ) (2) Unusual and Compelling Urgency per 41 USC §3304(a)(2) as implemented by FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per 41 USC §3304(a)(3) as implemented by FAR 6.302-3; ( ) (4) International Agreement per 41 USC §3304(a)(4) as implemented by FAR 6.302-4 ( ) (5) Authorized or Required by Statute per 41 USC §3304(a)(5) as implemented by FAR 6.302-5; ( ) (6) National Security per 41 USC §3304(a)(6) as implemented by FAR 6.302-6; ( ) (7) Public Interest per 41 USC §3304(a)(7) as implemented by FAR 6.302-7; Demonstration that the Contractor s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The El Paso VA Pathology & Laboratory Management Service is currently using the RALS Web3 system. As stated in Section 3 above, the only known contractor that can provide the RALS Web3 computer software interface and service agreement is Abbott Rapid Diagnostics Informatics, Inc. (Abbott), who is a Large Business. Additionally, the RALS Web3 system is compatible with equipment and systems that are currently in place. The RALS Web3 data management system is a vendor neutral system that eliminates the need for device-specific data managers. This makes point-of-care programs more efficient by having a centralized system for managing patient and quality control data from several point-of-care devices using one system. The procurement of device-specific systems would cause a duplication of costs, as systems would need to be procured to support devices manufactured by several different companies including Roche, Quidel, Abbott, Siemens, and Medtox. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A Notice of Intent to Sole Source was published on Contract Opportunities from 12/21/2020 through 12/28/2020. There were no responses. Based on market research conducted, the RALS Web3 computer interface is only available through Abbott. It has been determined to be in the Government s best interest to proceed with a sole-source procurement to Abbott to avoid further delays that can impact patient care at the El Paso VAHCS. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer has anticipated the proposed prices will be fair and reasonable. The prices of these services will be compared to prices of other recent NCO-17 procurements for RALS Web3 computer software interface. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: NCO-17 conducted market research by searching the mandatory sources for the procurement of services on UNICOR and Ability One. These mandatory sources do not offer RALS services. A search conducted on the Vendor Information Pages (VIP) did not identify a SDVOSB or VOSB that can provide the requested services. A search using the SBA s Dynamic Small Business Search (DSBS) tool did not identify a small business that can provide the requested services. Abbott stated in an email dated November 10, 2020 they do not offer these services on GSA Schedule, nor do they partner with any other businesses Large or Small to provide these services. Any Other Facts Supporting the Use of Other than Full and Open Competition: The only known contractor that can provide the RALS Web3 computer software interface and service agreement is Abbott Rapid Diagnostics Informatics, Inc. The RALS Web3 data management system is a vendor neutral system that eliminates the need for device-specific data managers. The procurement of device-specific systems would cause a duplication of costs, as systems would need to be procured to support devices manufactured by several different companies including Roche, Quidel, Abbott, Siemens, and Medtox. This duplication of cost could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. As such, adverse patient outcomes would be unavoidable. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted on future procurements to determine if there have been any changes in the marketplace for these services.
