The contractor shall perform the services cited herein at the Caven Point Marine Base; 3 Chapel Avenue, Port Liberte; Jersey City, NJ 07305.� The facility is on the waterfront of New York Harbor bordering on the waters of Claremont Channel on the east, south and west and on Chapel Avenue on the north.� A security fence isolates the facility on the northern and western perimeter.� Within the northern security fence are two gate openings the major one of which, on the eastern end, is active and the other of which, on the western end, is closed except in emergencies.� The facility consists of approximately 6 acres of land.� There is one main building, a storage building and a trailer complex on the facility.� Various sizes of floating plant berth alongside the bulkhead and at finger piers.� Approximately 100 civilian employees work at the facility. b. The time of performance of contract work within the term of the contract shall commence upon notification to the contactor by the Contracting Officer�s representative (COR) that a force protection condition and threat level exists that requires the implementation of contract services by the contractor.� The time of performance of the contractor�s services shall end when the COR informs the contractor of the cessation of such conditions.� The force protection conditions and threat levels pertinent to this contract are �FPCON BRAVO�, �FPCON CHARLIE� and �FPCON DELTA�. GENERAL REQUIREMENTS.� a. The contractor shall be licensed in the State of New Jersey and shall comply with all State and local laws applicable to security guards.� Where required by local law or ordinance, prior to the commencement of work the contractor shall obtain and furnish copies of any licenses, permits, etc. for the contactor and for each employee serving as an unarmed or armed security guard. b. The contractor shall furnish trained personnel, uniforms, equipment, material, and supervision (with the exception of Government-furnished facilities, equipment and materials specified herein) to satisfactorily maintain the physical security of the Caven Point Marine Base facility. c. Services performed under this contract shall be subject to inspection and acceptance by the Contracting Officer or his duly authorized representative, the Contracting Officer�s representative (COR). d. The contractor shall endeavor to prevent the occurrence of fires, explosions and other catastrophes, whose sole or contributing cause is hostile action, by close observation of the vehicles and personnel attempting to enter the facility.� In general, the contractor�s activities shall be confined to a guard shack and its immediate area located on the facility as desired by the COR.� However, the contractor is responsible for security services throughout the Marine Base and may be required to go anywhere for such activities thereon.� Upon a citing by the contractor of any hostile condition, the COR or his designee shall be notified. e. The contractor shall prepare and submit a full report of incidents that are considered security breaches, violations of administrative regulations, or the contractor�s assignment as set forth herein.� See paragraph 12 entitled, �Record Keeping� for daily reporting requirements.� Daily reports shall be supplemented as required to fully detail all unusual events/incidences. f. The contractor shall maintain records and submit reports in accordance with appropriate regulations, directives and orders and requirements contained herein. g. All guards reporting for duty shall adhere to the following: 1) Complete, clean and neat uniform. 2) Personal appearance acceptable for the security profession. 3) Physically capable of standing watch (i.e., physically capable of performing duties, free of intoxicants including alcohol and drugs, sufficiently rested, etc). h. All guards shall be fluent in the English language and shall be capable of understanding instructions and all special orders. SUPERVISION. a. Contract Manager.� The contractor shall designate in writing a contract manager to include the manager�s name, address and 24-hour telephone number(s) upon award of the contract.� The term �contract manager� means a person designated by the contractor to have complete authority to act for the contractor during the term of the contract.� The contract manager shall have the authority to assign/remove contractor personnel, submit reports, perform inspections, accept notices of deductions, authorize corrective actions and shall be the primary point of contact for the Government for administrative issues. b. Local Supervisor.� The contractor shall designate in writing a company representative to serve as a local supervisor and local point of contact for operational issues on a 24-hour basis.� (Note: If the contractor is based within 50 miles of the Caven Point Marine Base, the Contract Manager may serve as the Local Supervisor.)� The local supervisor shall conduct random unannounced site visits no less than twice monthly to review the performance of the guards assigned to this contract to insure compliance with contract requirements.� The local supervisor shall submit a report of findings to the Chief, Physical Support Branch within two days of the unannounced visit noting any observations, deficiencies and proposed corrective actions.� The local supervisor shall have authority to assign alternate guards in the case of unscheduled absences of scheduled contract guards, to take appropriate immediate action if assigned guards are unable to complete their tours, and to implement immediate corrective actions for contract deficiencies. c. Level of Supervision.� As a minimum, the contractor shall provide a level of supervision necessary to ensure contract guards: 1) Are properly trained to perform all duties specified and meet the minimum qualifications of personnel included in this specification. 2) Are properly uniformed and present a neat appearance. 3) Possess all necessary permits, authority, and licenses. 4) Are physically qualified to meet the physical demands of the job. 5) Fully understand their responsibilities and all contract requirements. �������������������������������������������������������������������������������������������������������������������������������������� QUALIFICATIONS OF PERSONNEL.� To be eligible to perform under this contract each contract employee must meet the following age, education/experience, medical and security requirements: ���� a. Age. All contract employees shall be minimum of twenty-one years of age (age requirement may be waived by the Contracting Officer for veterans of military service and for active duty military personnel). ���� b. Education/Experience. Contract guards must possess a high school diploma or equivalency and have two (2) years of experience demonstrating they have the following abilities: 1) The ability to fluently speak and converse in the English language, understand and apply rules, detailed orders, instructions, and training materials; 2) The ability to read the English language, understand and apply rules, detailed orders, instructions and training materials; 3) The ability to maintain poise and self-control under stress; 4) The ability to construct and write clear, concise, accurate and detailed reports in the English language. ���� c. Medical. Contract guards must be physically capable of performing the tasks required under this specification.� The government reserves the right to require the contractor to provide a medical clearance for any contract guard assigned to work at the Caven Point Marine Base if there is a concern regarding the guard�s physical capability to safely and competently perform the required activities. ���� d. Security. The contractor is required to insure that all employees assigned to this contract have been adequately screened and meet the standard requirements for security personnel.� They will be subject to a background check by the Federal Government. They must be a citizen of the United States of America or an alien who has been lawfully admitted for permanent residence as evidenced by Alien Registration Service that employment will not affect his/her immigration status.� Acceptable evidence must consist of a birth certificate or appropriate naturalization papers. HOURS OF WORK AND WORK SCHEDULING.� ���� a. Hours of Work.� 1) Unarmed guard services will be provided for a twelve (12) hour period each day, five (5) days per week, Monday through Friday, between the hours of 0600 and 1800 hours. The contractor is not required to work on weekends and Federal holidays.� The term of this contract is one base year, with two option years. .� ���� b. Work Schedules.� The contractor shall prepare and submit to the Chief, Physical Support Branch a work schedule identifying (by name) the guard assigned to each daily tour of duty.� The schedule shall be submitted a minimum of one week prior to performance.� Changes to the schedule shall be submitted in writing prior to the change. 1) No contractor personnel shall be on duty on either a fixed or mobile post for more than twelve (12) consecutive hours in a twenty-four hour period or in the excess of sixty (60) hours per week except in an emergency situation and when approved by the Contracting Officer�s representative. 2) No contractor employee shall be permitted entry to the Caven Point Marine Base facility except to perform assigned guard or supervisory duties. LIQUIDATED DAMAGES--DEDUCTIONS FOR NON-PERFORMANCE.� Should the contractor fail to provide specified productive services or if provided services do not meet the requirements of this specification, the contractor shall pay to the Government, as liquidated damages, the hourly rate of $57.36 for the period the contractor fails to provide the required level of services.�� MAN-HOUR REPORTING REQUIREMENTS.� The contractor shall submit a certified payroll report monthly with his payment invoice.� The certified payroll report shall include appropriate documentation of hours worked at the facility by each productive and supervisory employee(s) during the report period.� The report shall also contain the exact date(s) and time(s) of performance of any emergency services ordered by the Government. REMOVAL FROM DUTY.�� ���� a. The Government may require the contractor to immediately remove any employee(s) from the worksite should it be determined that the individual(s) assigned to duty has been disqualified for either suitability or security reasons, or is found to be unfit for performing security duties during their assigned tour(s).� The Contractor must immediately remove and provide an acceptable replacement for any such employee.� The Government retains the right to permanently rescind the right of any employee to perform duties under this contract should the employee�s performance so warrant.� For clarification, a determination that an employee is unfit may be made for, but not limited to incidents involving any of the following: 1) Violations of facility rules, regulations, or standards of conduct; 2) Neglect of duty, including sleeping while on duty, unreasonable delays or failure to carry out assigned tasks, conducting personal affairs during official time, and refusing to render assistance or cooperate in upholding the integrity of the security program at he worksite; 3) Falsification or unlawful concealment, removal, mutilation, or destruction of any official documents or records, or concealment of material facts by willful omissions from official documents or records; 4) Disorderly conduct, use of abusive or offensive language, quarrelling, intimidation by words or actions, or fighting; 5) Participation in disruptive activities which interfere with the normal and efficient operations of the Government; 6) Theft, vandalism, immoral conduct, or any other criminal action; 7) Selling, consuming, or being under the influence of intoxicants, drugs or substances which produce similar affects; 8) Improper use of official authority or credentials; 9) Unauthorized use of Government property, including information management and communications equipment. b. The Contracting Officer�s decision regarding the removal of any employee(s) from the worksite will be final.� Specific reasons for the removal will be provided to the Contractor in writing. GOVERNMENT-FURNISHED PROPERTY. a. The contractor shall take all reasonable precautions in accordance with sound industrial security practices to safeguard and protect the Government property and maintain it in a clean serviceable condition.� The Contractor assumes the risk of, and shall be responsible for, any loss of or damage to Government property in his possession except for reasonable wear and tear and to the extent that such property is consumed in the performance of the contract. b. All property furnished by the Government under this contact shall remain the property of the Government, and upon termination of the contact the Contractor shall render an accounting of all such property which has come into his possession under the Contract. c. The Government shall not be responsible in any way for damage to the Contractor�s supplies, materials or equipment or to the Contractors employees� personal belongings brought into the building or onto the grounds resulting from fire, theft, accident, or other disaster. d. The Government shall provide to the contractor for use in connection with this contract the following property: 1) Telephones for official use only�no personal or non-contract performance calls are authorized; 2) Heat, light, and other utilities; 3) Security guard working space is a guard shack; 4) Standard US Army and Government forms and regulations; and 5) Remote control to access gate. ���� e. The Government property made available under this contract shall be for official Government use only in the performance of the resulting contract.� Government property will be returned on termination of the contract prior to the contractor receiving final payment. ���� f. The Government shall provide normal maintenance and repair of the property furnished to the Contractor under the resulting contract. ABSENCES.� The contractor shall have an available staff that can fill in for absences of scheduled guards resulting from emergencies or illness.� If for any reason an on-duty contract guard cannot complete his scheduled tour, the contract guard is required to contact the contractor�s local supervisor to request relief.� The guard shall remain at the facility until an alternate contractor appointed relief guard arrives to relieve him.� At no time shall the contractor personnel leave the facility unattended during designated contractor hours. RECORD KEEPING.� ���� a. Daily Report.� A daily report shall be prepared by contract guards to document their activities and provide a record of messages, occurrences and incidences.� A copy of the daily log shall be submitted at the end of each shift to the Chief, Physical Support Branch or his designee for review.� As a minimum, the daily report must include: 1) Contract guard�s name, date, start and finish times for the tour of duty; 2) Description of any incidents; and 3) All instructions/information passed on by the contract guard to his/her relief guard at the end of his shift. ���� b. Local Supervisor Inspection Report.� The local supervisor inspection report shall be submitted within two days of completion of each bi-monthly unannounced facility inspection providing observations, deficiencies and proposed corrective actions. ���� c. Man-hour Report.� Man-hour report shall be submitted monthly in accordance with paragraph 8 above. SECURITY PERSONNEL TASKS/RESPONSIBILITIES.�� a. Security Check Station Requirements under FPCON NORMAL, ALPHA or BRAVO.� The contractor shall perform the following duties with unarmed personnel at the security check station located at the operating gate of the facility when the contractor has been informed that a certain force protection condition and threat level exists: 1) Log in all incoming vehicles by recording their license plate numbers and make and style of vehicle; 2) Log in the number, gender and approximate ages of vehicle occupants or pedestrians; 3) Perform a visual interior inspection of any vehicle entering the Caven Point Marine Base facility; 4) Perform a visual inspection of the interior of any packages and cases in any vehicles or carried by any pedestrians and vehicle trunks or other cargo areas; 5) Inquire as to the purpose of the visit of the vehicle�s occupants or pedestrians; 6) Perform random checks upon entering vehicles to include an examination of the undersides of vehicles using a hand-held mirror; 7) Allow vehicles or pedestrians to enter the facility only upon recognition of no apparent threat. 8) When authorized by Chief, Physical Support Branch, accept and sign for all mail deliveries, including UPS, FEDEX, and Airborne Express, etc. b. Security Check Station Requirements under FPCON CHARLIE AND FPCON DELTA.� The contractor shall perform the following duties with armed personnel at the security check station located at the operating gate of the facility when the contractor has been informed that a certain force protection condition and threat level exists: 1) Perform all checks under FPCON NORMAL, ALPHA and BRAVO above; 2) Visually inspect all entering vehicle spaces including engine, passenger and storage spaces; 3) Visually inspect the underside of all entering vehicles using a hand-held mirror; 4) Visually inspect all pedestrian and vehicle occupant identification; 5) Visually inspect the interiors of all packages and cases; 6) Allow vehicles and pedestrians to enter the facility only upon recognition of no apparent threat; 7) When authorized by Chief, Physical Support Branch, accept and sign for all mail deliveries, including UPS, FEDEX, and Airborne Express, etc. 8) Between 1800 and 0600 hours patrol the perimeter of the facility checking fences, equipment and visible exteriors of buildings and enclosures for possible security violations. c. Mixing of Threat Level Requirements.� The requirements for FPCON NORMAL, ALPHA, BRAVO, FPCON CHARLIE and FPCON DELTA may be mixed into a daily assignment to the contractor from time to time.� This will require the contractor to respond with the appropriate personnel of the higher level (FPCON CHARLIE and FPCON DELTA: armed personnel) for the particular assignment. d. Coordination With Facility�s Marine Dispatcher and Shipkeeper.� The contractor shall respond to a threat condition as reported by the facility�s Marine Dispatcher or Shipkeeper regardless of the threat level declared to the contractor.� This will necessitate the contractor�s confronting and restraining any illegal activity on the facility within the contractor�s legal right to do so.� Any perpetrators of criminal acts upon the facility shall be remanded to the custody of the Jersey City Police Department.�� PROHIBITION AGAINST CONTRACT WITH DETECTIVE AGENCIES a. Contracts with �Pinkerton Detective Agencies or similar organizations� are prohibited by 5 U.S.C. 3108. This prohibition applies only to contracts with organizations that offer quasi-military armed forces for hire, or with their employees, regardless of the contract�s character. An organization providing guard or protective services does not thereby become a �quasi-military armed force,� even though the guards are armed or the organization provides general investigative or detective services. (FAR Part 37.109) MINOR CHANGES TO CONTRACT.� Minor changes to the tasks required to be performed by the Contactor�s personnel may be made during the contract.� Such changes shall not require a written modification to the basic contract provided the change is within the scope of the basic contract and the change does not affect the Contractor�s man-hours or otherwise affect the Contractor�s cost for performing the work.
