- Department of Veterans Affairs Veterans Health Administration SPECIAL NOTICE NOTICE OF INTENT - SINGLE SOURCE Palo Alto Package # 22 CerebralMechanics OptoMotry HD System ECMS ACTION NUMBER 36C776-21-AP-0908 The Department of Veterans Affairs (VA) Veterans Health Administration (VHA) requires: CerebralMechanics OptoMotry HD System. The Program Contracting Activity Central (PCAC), National Activations Office (NAO) intends to complete a Single Source award to CerebralMechanics, Inc. for one (1) OptoMotry HD System. This procurement is being conducted in accordance with FAR Parts 12.203 and 13.106-1(b) and (c). The NAICS code for this procurement is 334516 and the Small Business Administration Size Standard is 1,000 employees. ADMINISTRATIVE: The VHA, PCAC intends on awarding this contract pursuant to FAR 13.106-1(b)(1) Soliciting from a single source (1) for purchases not exceeding the simplified acquisition threshold. (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). It is anticipated that a firm-fixed-price contract will be awarded in accordance with Federal Acquisition Regulation (FAR) Parts 12 and 13.106-1(c). The North American Industry Classification System (NAICS) code for this requirement is 334516 with a small business size Standard of 1,000 employees. Pursuant to VAAR 819.7007 (b) The contracting officer s determination to make a sole source award is a business decision wholly within the discretion of the Contracting Officer; however, responsible sources may identify their interest and capability to respond to the requirement by submitting a capability statement. The capability statement must include documentation that provides evidence of the contractor s ability to meet the Government s requirement. A business that intends to provide equipment manufactured by others must include in its capability package a letter or other documentation from the original equipment manufacturer(s) (OEM) stating the business is an authorized distributor of the proposed item(s). CerebralMechanics, Inc. is a Large Business verified in SAM. CerebralMechanics, Inc. does not have authorized distributors. Therefore, no set-aside is appropriate for this requirement. FAR 13.106-1(b)(1)(i) states that contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. VA prioritizes awarding contracts to SDVOSBs and VOSBs when possible. To be considered an SDOVSB or VOSB under VA s Veterans First Contracting Program, SDVOSBs and VOSBs must be verified in VA s VIP database (https://www.vip.vetbiz.va.gov/). SDVOSBs/VOSBs not verified as such in VIP are not eligible for consideration under VA s Veterans First Contracting Program. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government.
