Description
This Synopsis is a Presolicitation Notice for the U.S. General Services Administration (GSA), Public Buildings Service, Northeast and Caribbean Region.� This notice is neither a solicitation announcement, nor a request for proposal or related documents. Project Description: This Presolicitation Notice is for Construction Manager as Constructor (CMc) services required for the Alexander Hamilton U.S. Custom House (Custom House) Water Infiltration Remediation Project located at 1 Bowling Green in New York, NY.� The building is listed on the National Register of Historic Places.� This work is a major Repair and Alteration project, and will include a two-phase approach to address building deficiencies at the Custom House.� This Notice contemplates the procurement effort for Phase I, which will mitigate water infiltration issues into the vaults and repair the structure of the vaults.� Phase II of the project (Replacement of exterior windows and skylight, laylight and rotunda ceiling repair) will be procured separately at a later date and is not contemplated under this Notice.���� The CMc shall be a member of the project development team during the design and construction phases of the project, working with the Government's selected Architect-Engineer (A/E), Construction Manager as Advisor (CMa), and the Government representatives to ensure a quality project, within the mandated schedule and budget. The CMc contract will include two phases of work: Design Phase Services and Construction Phase Services. The CMc will perform design phase services including, but not limited to: scheduling, estimating and providing cost information, performing functionality and constructability reviews, developing construction sequencing and phasing plans, value management, risk management, and engagement and coordination with stakeholders and local agencies such as the New York City Department of Transportation, the New York City Department of Buildings, the New York City Department of Parks and Recreation, and the Metropolitan Transportation Authority.� The CMc must be able to demonstrate experience in historic preservation. Construction phase services work includes all necessary labor, equipment, materials, supervision, management and administration to provide the water infiltration remediation scope as designed, including waterproofing at the ground level and below grade and structural repairs or replacements. Contract Type: The contract type will be Fixed-Price-Incentive.� The base contract for design services is anticipated to be awarded at a firm-fixed price. The initial contract award will also include an Estimated Cost of Work (ECW), CMc Contingency Allowance (CCA), and proposed Fixed Fee. The ECW is set by the Government at $42,000,000 to $52,000,000 for the project. The ECW is the estimated cost of the construction work, not including home office overhead.� The CCA is an allowance to cover reimbursable costs during construction that are not the basis of a change order.� The Fee for Construction Work is the amount established in the construction contract for the CMc's profit and home office overhead costs for construction phase services. The sum of the ECW, CCA, and Fee for Construction Work constitute the Guaranteed Maximum Price (GMP).� The GMP is inclusive of the proposed Fixed Fee.� GSA may adjust the ECW� based on design phase services to negotiate a final ECW, but the Fee for Construction Work does not adjust. The GMP will be tracked through open book accounting that will be reviewed and monitored by GSA and the CMa.� The GMP is similar to a ceiling price described in FAR 16.403-2, but is specifically tailored for CMc project delivery. After the CMc and GSA have agreed to the scope at 100% design completion, the Government and the CMc may agree to bilaterally modify the line item for Construction Phase services from the GMP to a firm-fixed price.� The firm-fixed price for construction phase services must not be in excess of the GMP. Construction Phase Services are only required if the Government elects to exercise the option. The Government reserves the right not to exercise the option for Construction Phase Services if the GMP exceeds $42,000,000 - $52,000,000, if there is no agreement on the scope, or if it is not in the Government's best interest. The project will still be in the design phase when the CMc contract is awarded; therefore, a firm-fixed price cannot be established for Construction Phase Services. The benefit of awarding the CMc contract for Design Phase Services prior to completion of the design is that the firm will provide constructability reviews, project coordination, cost estimates, and other specified services to allow for full collaboration with the A/E, CMa, GSA, Custom House tenant agencies, and others during design.� CMc also provides benefits through allowing certain construction activities to begin prior to design completion. Certain activities may be identified for fast track completion (e.g. demolition as an early work package) to deliver the project quicker than alternative methods of project delivery.� Early work packages must be converted to a firm-fixed price once the scope is fully specified. Price: The ECW range is set by the Government at $42,000,000 - $52,000,000, and the target ECW is incorporated at award as part of the GMP.� The final ECW is negotiated during design phase services and incorporated into the option for the construction services after 100% design completion. The Government and CMc may agree to GMP line items for early work packages that must be converted to firm-fixed price. The construction services option is adjusted for the cost of the work packages through the reduction of the ECW by the fixed-price amount of the cost of those work packages, and the GMP is adjusted downward, as appropriate. Selection and Schedule: This requirement will be procured under Full and Open Competition in accordance with FAR Subpart 6.1.� The selected offeror will be competitively chosen using Source Selection Procedures in accordance with FAR Subpart 15.3.� The objective of the Source Selection Process is to select a proposal that represents the best value to the Government.� The period of performance for the base design phase services will be August 2021 to January 2022. The period of performance for the construction phase services option (if exercised) will be August 2023 to January 2027. Magnitude of Construction: The Estimated Cost of Construction at Award range is $42,000,000 to $52,000,000. NAICS: The North American Industry Classification System (NAICS) code associated with this procurement is 236220, Commercial and Institutional Building Construction, and the Small Business Administration size standard is $39.5 million. Solicitation Information: GSA anticipates issuing the Solicitation on or about March 19, 2021, with receipt of proposals at a minimum of thirty (30) calendar days later.� All information, amendments and questions concerning this solicitation will be electronically posted to the Governmentwide Point of Entry at beta.SAM.gov.� No telephone requests will be accepted and no paper copies will be mailed to prospective offerors. All offerors are required to have an active registration in the System for Award Management (www.sam.gov) at the time of offer submission. In addition, in order for contractors to have access to Federal space, the contractor will be required to adhere to the HSPD-12, Directive Clearance Process, in accordance with FAR� 52.204-9 � Personal Identity Verification of Contractor Personnel (JAN 2011).
