Description

INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC) on behalf of the Clinical Center Materials Management and Environmental Services Department�lintends to negotiate and award a contract without providing for full and open competition (including brand-name) to: Advanced Steriliation Products, Inc 33 Technology Drive Irvine, CA 92618-2346 NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE, The intended procurement is classified under NAICS code 811219�with a Size Standard $22,000,000.00. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2021-03�January 14, 2021. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. The Sterile Processing Section of Materials Management is requesting a Preventative Maintenance Agreement from Advanced Sterilization Products Services Inc. for the Sterrad 100NX AllClear machine. This request serves as a critical function. In order to ensure that the machine is functioning properly and providing sterilization to medical devices that require low temperature sterilization this service is critical to its success. It is also the requirement of the Joint Commission to be able to provide documents upon request that sterilization machines are serviced in accordance with the manufacturers Instructions for use. If there are other sources able to supply the required material, they must respond by submitting a capability statement within 10 days of publication of this synopsis This notice of intent is not a request for competitive proposals. However, all proposals received prior to the closing date of this synopsis will be considered solely for the purpose of determining whether to conduct a competitive procurement. �A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government.
