Description
The 10th Contracting Squadron (10 CONS/PKB), United States Air Force Academy (USAFA) intends to award on a Sole Source basis to O.R. Elder, Inc., a SDVOSB, for one Centurion phacoemulsification vision system manufactured by Alcon Vision, LLC. This notice documents and incorporates provisions and clauses in effect through Federal Acquisition Circular FAC 2021-05, effective 10 March 2021. 10th Medical Group currently has a requirement for an Alcon Centurion phacoemulsification vision system which is intended for use in small incision cataract lens extraction and IOL injection surgical procedures. Alcon Vision, LLC is the manufacturer of the equipment and O.R. Elder, Inc., a SDVOSB concern, is their only authorized seller and distributor. This procurement is for the acquisition of a sole source commercial item using simplified procedures in accordance with FAR Parts 12 & 13. The North American Industry Classification System Code (NAICS) is 423460 and the business size standard is 150 employees. 1.�� �Only one responsible source, and no other, will satisfy this requirement. 2.�� �The Alcon Centurion system is the only piece of equipment that will satisfy this requirement in order to maintain standardization as there is an existing Alcon Centurion unit in the ophthalmology operating room. The following summarizes the justification and approval of single source from O.R. Elder by detailing the proprietary nature of the requirement, as well as requirements that other vendors do not meet. a.�� �Alcon Vision, LLC, the manufacturer, submitted documentation to 10 CONS that O.R. Elder, Inc., a SDVOSB, is the distributor for Alcon Vision surgical products. b.�� �An additional phacoemulsification unit is required. For standardization in the operating room, the new machine must be an Alcon Centurion. c.�� �IAW FAR 18.116 Service-disabled Veteran-owned Small Business (SDVOSB) sole source awards, contracts may be awarded to Service-disabled Veteran-owned Small Business (SDVOSB) concerns on a sole source basis. This synopsis is for notification purposes only and does not constitute a solicitation for bids or proposals. DO NOT submit a bid/quote in response to this notice. Any offerors believing they can provide the Centurion vision system manufactured by Alcon Vision, LLC may provide evidence for consideration. Evidence must clearly support the offeror's claim that they can supply this piece of equipment. All qualified sources may submit a response, which if received timely, will be considered by this agency. Information received will be considered solely for the purpose of determining whether a competitive procurement can be conducted. A determination not to compete this proposed procurement based on responses to this notice is solely within the discretion of the Government. Responses must be received NLT 11:59 a.m. MDT on 02 April 2021. Responses received after this date will not be considered. The Government does not intend to pay for any information provided under this announcement. Contractors must have a current registration with the System for Award Management (SAM) at http://www.sam.gov/. The Government intends to award a firm fixed price purchase order processed in accordance with FAR 12 and 13. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern. (b)�� �Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions).
