Description
This is not a request for proposal. This is a notice of the Government�s intent to issue a sole source award contract to: Christopher Gross Consulting (CGC), Inc. 332 Minnesota Street, Suite W2700, Saint Paul, Minnesota, 55101. This contract will provide the Department of Labor/ Office of Workers� Compensation Programs (OWCP) actuarial liability estimates, and related audit support, for the Energy Employees Occupational Illness Compensation Program Act (EEOICPA), Black Lung Benefits Act (BLBA), and the Federal Employees� Compensation Act (FECA). DOL intends to negotiate and award a Hybrid Type Contract with Firm Fixed Price and Labor Hour CLINS with Christopher Gross Consulting, Inc. The contractor will provide casualty actuary services to do the following: Review, evaluate, and explain the Actuarial Liability for the Energy Employees Occupational Illness Compensation Program Act (EEOICPA); Review, evaluate, and explain the Federal Employees� Compensation Act (FECA) Future Workers� Compensation Liability estimate; Review, evaluate, and explain the Black Lung Disability Trust Fund (BLDTF) future liability estimate; and, Respond to questions about OWCP liability estimates from the Office of the Chief Financial Officer, Office of the Inspector General (OIG) and its auditors. The Contractor shall perform, as needed: Actuarial analysis of impacts to OWCP programs from the Black Lung Self Insurance Program, FECA Reform, other proposed legislative and regulatory changes, as well as impacts stemming from changing economic or market conditions; and, Recommendations of adjustments to current models, or design of new models to project actuarial liability. OWCP is required to produce these liability estimates throughout the year for Federal financial statements within the brief timeframes between the end of the fiscal year (for EEOICPA and BLBA)/end of the chargeback year (for FECA), and the date required by the Federal financial statement process. The estimates are reported in and audited as part of Federal financial statements each year. The work CGC is doing is not duplicated elsewhere in the private sector; there is only one Black Lung Disability Trust Fund, Energy Program and FECA Program and as such CGC has developed unique knowledge and skills. A new actuarial firm would need several months time of training to become familiar with the programs, the model structures and the data inputs. In particular, the FECA model uses a predicative modeling approach that requires specialized software that a new firm would need to lease from CGC or develop their own. The period of performance for this action is one twelve month base period and four twelve month option periods; for a potential total five year period of performance. The North American Industry Classification System (NAICS) is 524298 �which has a size standard of $16.5 Million. The statutory authority is FAR 41 U.S.C. 3304(a)(1) for services �available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency� as implemented by FAR 13.5.� This is a sole source notice published for informational purposes only and not a request for competitive proposals. Therefore, no solicitation document exists for this requirement However, all responsible parties interested in responding to this notice are invited to submit a capability statement by 5:00pm (ET), March 31, 2021,�that provides sufficient details for consideration to the government via email to: severe.jubner@dol.gov and cc: williams.helen.a@dol.gov. The determination not to compete the contract based on the responses to this notice is solely within the discretion of the Government. Phone calls will not be accepted in response to this notice. All information submitted should support the offeror�s capability to provide the items required, and shall be furnished at no cost or obligation to the Government. Responses must be in writing and must provide clear and concise documentation indicating an offeror�s bona fide capability to provide these services. Verbal responses are not acceptable and will not be considered. The Government reserves the right to cancel this requirement.
