Approved for Public Release 21-MDA-10744 (23 March 21) This announcement serves as notice of a proposed contract action, as required by section 5.201 of the Federal Acquisition Regulation. It is the intent of the Missile Defense Agency (MDA) to issue a sole source Undefinitized Contract Action (UCA) to Raytheon Company, Woburn, Massachusetts 01801 under the authority of FAR 6.302-1(a)(2)(ii). This modification of the Radar Production Contract is to procure one AN/TPY-2 Radar (Radar #13) with initial spares to support Terminal High Altitude Area Defense (THAAD) Battery #8. As an element of the THAAD system, the radars must be able to detect, track, and discriminate threat missiles and communicate with the THAAD interceptor during the various phases of the THAAD mission. Raytheon possesses the required facilities security clearance and Raytheon and its supply chain have production lines and processes which meet MDA quality, safety, and mission assurance requirements. If a source other than the incumbent is awarded a contract to build this hardware, prior to commencing production that source would need to undergo the MDA Quality, Safety, and Mission Assurance Directorate's production readiness validation program. This validation program is estimated to take 18 months based on historical data for the development and implementation of AN/TPY-2 since Radar #1. This includes approximately three months to determine allocation of prime and subcontractor work efforts, two months to determine key processes subject to Government review and approval, six months for an initial production readiness risk assessment and industrial capabilities assessment, three months for a low rate initial production approval rate capability review, and four months to conduct manufacturing process verifications (MPVs) and 10-15 delta MPVs per element. The program would be conducted at the prime, subcontract, and critical sub-tier supplier levels. At this time, it is in the Government's best interest to procure the AN/TPY-2 production requirements for FY 2021-2024 from Raytheon. Raytheon is the only responsible source currently able to meet the program milestones for delivery on schedule.
