SUPPLIES OR SERVICES & PRICES / COSTS PRICE SCHEDULE Scope: The Contractor shall furnish all equipment, personnel, labor, materials and services necessary to Supply & Deliver (F.O.B. Destination within Consignee s Premises) Clean Topsoil, and clean # 10 Granite Stone (Dust) and to Remove, Transport and Dispose-of (off-site) excess fill-dirt at the Culpeper National Cemetery, 501 E. Chandler Street and/or 305 U.S. Avenue, Culpeper, VA 22701 Site Visit: Offerors or quoters are urged and expected to inspect the site(s) where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Unit Price: The unit cost indicated in the Schedule is all-inclusive and covers supply and delivery of all topsoil ordered. Type of Contract: This is an indefinite-quantity contract for the supplies / services specified and effective for the period stated in the Schedule. This contract provides for an indefinite quantity of services within stated limits, to be furnished during the contract period with deliveries or performance being scheduled by placing orders with the Contractor. The quantities of services specified in the Price Schedule are estimates only and are not purchased by this contract. Quantities beyond the stated maximum may be ordered if mutually agreed upon by the Government and the Contractor. Except as this contract may otherwise provide, if the Government' s requirements do not result in orders in the quantities described as "" estimated"" or "" maximum"" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment. Maximum & Minimum Quantities: Delivery shall be made only as authorized by orders issued in accordance with the Ordering clause. The Contractor shall furnish to the Government the supplies and/or services specified up to and including the quantity designated in the Schedule as the Maximum. The Government shall order at least the quantity of topsoil designated in the Schedule as the Minimum. Destination within Consignee s Premises) Clean topsoil consisting of fertile, friable, natural earth of loamy character, without a mixture of subsoil, uniform in quality with 5% composted material and free of refuse of any nature hard clods, stiff clay, sod hard pan, pebbles larger than 1/4 in diameter, course sand, noxious weeds, stick brush, other rubbish, etc. Topsoil shall contain at least 5% organic matter determined by loss on ignition on moisture-free samples dried in accordance with the current method of the association of official agricultural chemist. The acidity range shall be PH 5.0 to 7.0 inclusive. Minimum amount will be 380 yards to be used as need basis. Delivery of clean topsoil to the cemetery will be made in 30 yard increments on a quarterly basis as determined by the COR. On an as-needed / as-requested basis , the Contractor shall remove; transport and dispose-of (off-site) excess fill-dirt from the Culpeper National Cemetery. Excess fill-dirt located in the designated Spoils Area shall be maintained at a level no greater than six cubic yards. It is estimated that thirtywenty (320) cubic yards of excess fill-dirt will accumulate monthweekly. Cemetery staff (COR) will contact and notify the Contractor when fill-dirt is to be removed from cemetery grounds. Removal will consist of roughly 90 yards of excess fill dirt per quartermonth. Removal of excess fill dirt will be made within 3 days after notification of the Contractor by the COR. Contractor will be required to utilize his own equipment for the loading of dirt at cemetery that is scheduled for removal. The Contractor is responsible for the cleaning of all road surfaces during fill-dirt removal. Fill-Dirt Disposal: All excess fill-dirt removed from Culpeper National Cemetery shall be disposed of at a licensed off-site landfill at the Contractor s expense. Contractor is required to obtain all necessary licenses and/or permits as required by State and local law. (INSERT SPECIFICATION FOR #10 GRANITE STONE (DUST) FROM ASTM DELIVERY Each truck shall carry at least 30 cubic yards of dry weight topsoil and 10 cubic yards #10 Granite Stone (dust) per truck load. The topsoil and #10 granite stone (dust) will be spread upon delivery by Culpeper National Cemetery Personnel. Orders for Topsoil and #10 granite stone (dust) shall be placed on an as-needed / as-requested basis by the Culpeper National Cemetery Contracting Officer s Representative (COR) or designee. Unless otherwise agreed upon, delivery and removal shall be made between the hours of 8:00 A.M. and 1:00 PM. Orders for delivery of clean topsoil shall be delivered within 5 hours after request. CONTRACT MANAGEMENT Contracting Officer s Technical Representative: The VA Contracting Officer will delegate one (or more) representatives to serve as the Contracting Officer s Representative (COR). The COR may direct and arrange the Contractor s work schedule in specific areas of the cemetery to coordinate with daily cemetery activities and operations. Duties and responsibilities of the COR include day-to-day monitoring of the contract as follows: Providing contract oversight and technical guidance to the Contractor. Placing orders for services. Verification / certification of payments to the Contractor for services rendered. Assuring that any changes effecting work involved, price, terms and/or conditions under the contract are not implemented before written authorization is issued by the Contracting Officer. All administrative functions remain with the VA Contracting Officer. Any modifications to the contract, including those involving no-cost changes, increases and decreases in cost or level of services provided, termination or extension of the contract (in part or in whole) and decisions concerning claims or disputes, must be authorized in writing by the Government Contracting Officer. Site Manager: A competent and experienced Site Manager shall be provided by the Contractor whenever work is being performed. In the absence of the Site Manager, the Contractor will appoint a crew foreman or employee who will be responsible to einsure that the work is -- being accomplished in an expeditious manner; performed in accordance with the contract specifications; progress is being made without undue delay; and Communication & Coordination of Work with COR: Communication with the COR (or designee) is strongly encouraged. The Site Manager will ensure all specifications are being met, ensure contract work does not conflict with ceremonies and funerals, and ensure employees are adequately supervised and proper conduct is maintained. RESPONSIBILITIES Safety: The Contractor is responsible for ensuring that all work is performed in a manner that safeguards VA National Cemetery Visitors, Government Employees, and the General Public. Matters related to safety must meet safety requirements of the Culpeper National Cemetery Safety Policies, Department of Veterans Affairs, OSHA Standards and the State of Virginia. Contractor s employees shall wear all required safety equipment such as goggles or face shield, hearing protection, hard hats, respirators, if required, and uniforms identifying them as an employee of the Contractor. The Contractor is responsible for training its personnel and complying with OSHA safety standards and guidelines. Licenses & Permits: The Contractor shall obtain all necessary licenses and/or permits necessary for contract performance. Contractor shall take all precautions necessary to protect persons and property from injury or damage during the performance of this contract. The Contractor is responsible for any injury to itself, its employees, or others, as well as for any damage to personal or public property that occurs during performance of this contract that is caused by the fault or negligence of the Contractor and/or its employees. Insurance: The Contractor shall, at its own expense, provide and maintain during the entire performance of this contract, at least the kinds and minimum amounts of insurance required in the Schedule or elsewhere in the contract. The Contractor shall provide for itself and employees, the types of insurance necessary to operate all loaned equipment. In no way will the Government be responsible for accidents or injury caused by the Contractor and/or its personnel. Before commencing work under this contract, the Contractor shall notify the Contracting Officer in writing that the required insurance has been obtained. Damage to Government Property: The Contractor is responsible for damages to any cemetery structure, including turf, curb, road pavement, headstone or marker, permanent floral vases, valve boxes, control markers etc, which is chipped, marred, damaged and/or ruined at the fault of the Contractor or its employees, and shall bear all costs associated with replacement and reinstallation. Any such damage shall be brought to the immediate attention of the Cemetery Director or designee prior to repair, replacement, and installation. FEDERAL HOLIDAYS All work required under this contract will be performed during normal cemetery hours of operation. Work is normally not conducted on Federal holidays.
