- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and A WRITTEN SOLICITATION WILL NOT BE ISSUED. This combined synopsis/solicitation N6134021Q0010 is issued as a Request For Quote (RFQ) and incorporates the provisions and clauses in effect from regulations posted to http://acquisition.gov/content/regulations. inclusive, but not limited to, Federal Acquisition Circular (FAC) number 2021-05.� This procurement is being solicited on the basis of a small business set-aside competition with an associated North American Classification System (NAICS) code of 511210 (Software Publishers) with a size standard of $38.5M. �The Naval Air Warfare Center Training Systems Division (NAWCTSD) Orlando has a requirement to procure a 1-year Exata software maintenance and technical support license for the Cyber Library for Exata network simulation/emulation software.� In addition, obtain a Joint Network Emulator (JNE), a Government-off-the-shelf (GOTS) library that runs on top of Exata, which provides user approval by a Government entity.� The maintenance and support for this software is required to continue utilizing the system effectively.� This license is for a network emulation software that evaluates communication networks faster and with more realism than any other tool.� This procurement is not sole source, but includes a brand name specification for the Exata brand of software (see J&A, attachment 1). The Exata software brand is the only product that can meet the Government�s needs for the reasons stated in the attached J&A. All responsible sources may submit a capabilities statement, which shall be considered by the agency. The Government solely for the purpose of determining whethera different brand can meet the need. Technical capability will be determined solely on the content and merit of the information submitted in response to this provision. Therefore, it is incumbent on the interested party to provide sufficient technical literature, documentation, etc. in order for the Government to make an adequate technical assessment.� Any response should also include a quote for the parts requested.� The parties are requested and advised to submit its best pricing as part of its response.� The Government reserves the right to process the procurement on a brand sepcific basis based upon the responses received. The Government will not pay for any information received. The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items applies to this acquisition with the addendum that Offerors are required to submit warranty information and parts availability with its offer. The Provision at FAR 52.212-2, Evaluation- Commercial Items, does not apply. This is a sole source action. The offeror(s) must submit a completed copy of the provision at FAR 52.212-3, Offeror Representation and Certifications-Commercial Items with its offer. The failure of an Offeror to provide information sufficient to determine conformance with the combined synopsis/solicitation may result in the Offeror being ineligible for award. All Offerors MUST BE IN THE SYSTEM FOR AWARD MANAGEMENT (SAM). Information concerning SAM registration requirements may be viewed via the Internet at https://www.sam.gov/portal/SAM/. Going forward, all new entities registering in GSA�s System for Award Management (SAM), as well as existing registrations being updated or renewed, will require the submission of an original, signed notarized letter identifying the authorized Entity Administrator for the entity associated with the Data Universal Numbering System (DUNS) number before the registration will be activated.� It is recommended that all interested parties be aware that processing this additional information may take several days and are proactive in maintaining the SAM registrations in an �Active� status as the government cannot award to an entity without an �Active� SAM registration.� More information can be found at www.gsa.gov/samupdate.
