VHAPM Part 808.405-6 Limiting Sources VHAPM Part 808.405-6 Limiting Sources Original Date: 08/30/2017 Revision 02 Eff Date: 02/21/2020 LIMITED SOURCES JUSTIFICATION ORDER >SAT FAR PART 8.405-6 Acquisition Plan Action ID: 36C261-20-AP-5003 Contracting Activity: Department of Veterans Affairs, Network Contracting Office (NCO 21) 855 M Street Fresno, CA 93721 2237#:640-21-3-5071-0003 Description of Action: This acquisition is conducted under the authority of the Multiple- Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). Order against: FSS Contract Number: GS-07F-0562X Name of Proposed Contractor: Trofholz Technologies Street Address: 250 Technology Way City, State, Zip: Rocklin, CA 95765 Phone: 916-788-8917 Description of Supplies or Services: The Contractor shall perform all administrative management, preventative and corrective maintenance on all installed physical security systems which includes physical access control systems (PACS), intrusion detection systems (IDS), and video assessment and surveillance systems (VASS). Additionally, the contractor shall maintain all necessary licenses and/or permits required to perform the work on the existing Sielox Card Access, WAMS, and Bridgeport System for the VA Palo Alto Health Care System. Period of Performance: 4/1/2021 3/31/2022. Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service. VHAPM Part 808.405-6 Limiting Sources Attachment 2: Request for Limited Sources Justification Format >SAT VHAPM Part 808.405-6 Limiting Sources Original Date: 08/30/2017 Revision 02 Eff Date: 02/21/2020 FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: x FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; This procurement is for Physical Access Control Systems (PACS) maintenance and repair services at the VA Palo Alto Health Care System Physical Security Office. The on-site technician maintains and repairs the PACS system for Palo Alto and 11 satellite locations. Indus Systems, a small business, was previously awarded a task order for these services. However, Trofholz Technology, Inc., a VIP verified Service-Disabled-Veteran-Owned-Small-Business (SDVOSB) has actually performed this service as a subcontractor to Indus Systems. Trofholz Technology, Inc. is a VIP verified SDVOSB, certified to work and perform services on Sielox systems, and has a GSA schedule for these services. While Sielox has other certified service providers throughout the nation, the Government does not expect to receive quotes from these vendors since none of them responded to the Government s sources sought. Sielox, the OEM of the security system, also stated that it does not perform any services but sub-contracts these services to certified third-parties such as Trofholz. The Government has therefore determined that Trofholz is the only source capable of providing services for the VAPAHCS. FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. FAR 8.405-6(b): Items peculiar to one manufacturer: A patent, copyright or proprietary data limits competition. The proprietary data is: These are direct replacements parts/components for existing equipment. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Trofholz Technologies, Inc. has a GSA contract, GS-07F-0562X, for these services. The labor rates have already been determined fair and reasonable by the GSA contracting officer. In addition, Trofholz performs all services in-house and does not require large amounts of sub-contracting to fulfill the need for VAPAHCS. Trofholz is certified by Sielox to perform services on its security systems within the VAPAHCS. Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted Trofholz Technology, Inc. has performed this service since July 2014 under the incumbent contract GS-07F-0522M VA261-14- F-2640, which was awarded to Indus Systems (Small Business). Trofholz served as the subcontractor performing the work and is an SDVOSB GSA firm under contract GS-07F-0562X. A sources sought was posted to BetaSAM to determine if there are any interested vendors that can perform this service. One VIP-verified SDVOSB vendor, HurtVET, responded as interested. HurtVET stated that it would rely upon subcontractors for the first few months of service to accomplish the tasks. They would then hire employees in the local area. They also stated that they are not currently certified to perform work on Sielox security systems but would obtain certification upon award. The Government reached out to Sielox to gain more understanding about its certification program timeline. A Sielox representative stated that the company is not currently providing any certification training due to COVID-19 restrictions and precautions. The company stated that the suspension is indefinite and that they have no timeline on re-starting training. This was confirmed by the Government when it attempted to access the training schedule on the Sielox website and saw that no sessions were listed. Sielox also stated that they themselves do not perform any repair or maintenance services but that they would sub-contract out any service requests to certified servicers, such as Trofholz. Given that HurtVet is relying upon gaining certification of the systems after award, it has no experience with Sielox security systems, and that Sielox is not currently providing any certifications, the Government does not believe HurtVET to be a viable source. HurtVET does not have a GSA contract. In addition, the Government is relying upon the authority in 38 U.S. Code § 8127(c) to sole source this requirement to Trofholz. Any Other Facts Supporting the Justification: 41 USC §3304(a)(5), 38 U.S. Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. In accordance with VAAR 819.7007, the contracting officer s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. Trofholz Technologies, Inc is an SDVOSB GSA firm under contract GS-07F-0562X. Based on the authority within 38 U.S. Code § 8127(c), a sole source award is being made to Trofholz for this service. A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: When a follow-on contract is needed, the Government will again assess the marketplace. If there is more than one VIP verified SDVOSB vendor interested in the requirement, the Government will consider competing the requirement under an SDVOSB set aside.
