- PRE-SOLICITATION NOTICE OF INTENT NON-COMPETITIVE SUBJECT Sony SH800SFP cell sorter maintenance agreement for NCATS REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures, and the procedures prescribed in FAR Subpart 13.106-1(b)(1), Soliciting from a single source. The resultant contract will include all applicable provisions and clauses of the FAR in effect through the Federal Acquisition Circular (FAC) 2021-05, dated March 10, 2021. DESCRIPTION Pursuant to FAR Subpart 5.2�Synopses of Proposed Contract Actions, THIS IS A PRE-SOLICITATION NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION.� The National Institutes of Health (NIH) is the nation�s leading medical research agency and the primary Federal agency whose mission is to seek fundamental knowledge about the nature and behavior of living systems and the application of that knowledge to enhance health, lengthen life, and reduce illness and disability, conducting, supporting and making medical discoveries that improve people�s health and save lives. The National Center for Advancing Translational Sciences (NCATS) is a part of the National Institutes of Health (NIH), which mission it is to catalyze the generation of innovative methods and technologies that will enhance the development, testing and implementation of diagnostics and therapeutics across a wide range of human diseases and conditions. The Sony SH800SFP Cell Sorter (S/N 0314053) allows users to take a population of cells and sort them out into different groups based on fluorescence signal present in each group. Once the instrument sorts the users' desired populations, the instrument can plate those cells into a variety of different plate types (6 well up to 384 well plate) that can then be used for further experimentation. This is the only instrument at NCATS that can plate sorted cell populations, therefore it is a critical piece of equipment used by multiple groups across the NCATS' Division of Preclinical Innovation (DPI) including the RSC. This instrument is highly complex utilizing various high-powered lasers and microfluidics and therefore needs yearly preventative maintenance (PM). In addition to the yearly PM, a service agreement would allow for any needed parts or repairs to be covered and more quickly obtained. ANTICIPATED SOURCE Sony Biotechnology Inc. 1730 North 1st Street, 2NW, San Jose, CA 95112 DUNS: 129614512 PERIOD OF PERFORMANCE The anticipated period of performance including options is as follows: Base Year: ���� �May 1, 2021 through April 30, 2022 (12-months) Option Year 1: May 1, 2022 through April 30, 2023 (12-months) Option Year 2: May 1, 2023 through April 30, 2024 (12-months) Option Year 3: May 1, 2024 through April 30, 2025 (12-months) Option Year 4: May 1, 2025 through April 30, 2026 (12-months) PLACE OF PERFORMANCE NIH NCATS BG 9800B RM 1026 9800 Medical Center Drive, Bldg B Rockville, MD 20850 REASON FOR NON-COMPETITIVE ACTION This instrument is highly complex utilizing various high-powered lasers and microfluidics and therefore needs yearly preventative maintenance (PM) which can be costly for an instrument not under a service agreement. In addition to the yearly PM, a service agreement would allow for any needed parts or repairs to be covered and more quickly without significant disruption to the continuity of the NCATS research projects. In accordance with FAR part 10, extensive market research was conducted to reach this determination. The material or service must be compatible in all aspects (form, fit, and function) with existing systems presently installed. The current equipment was obtained from Sony Biotechnology., and has been maintained by Sony Biotechnology., since acquisition. The new item/service must coordinate, connect, or interface with the existing system by replacing defective components exactly when required. Since Sony Biotechnology, Inc., is the manufacturer of its Sony SH800SFP Cell Sorter and does not sell replacement parts to third parties and does not permit maintenance services of the above instruments to be performed by third parties, only the original manufacturer can meet this requirement.�� CLOSING STATEMENT This synopsis is not a request for competitive proposals.� All responsible sources may submit a capability statement, however, which shall be considered by the agency. �Responses to this notice must include clear and convincing evidence of the offeror�s capability of fulfilling the requirement.� In addition, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size must be included in the response. �All offerors must have an active registration in the System for Award Management (SAM). A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.� The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement.�� All responses must be received by 11:00 AM Eastern Time on April 13, 2021.
