Amendment No. 1 to Request for Quote - Nautique Aquatic Herbicide (brand name or equal) for Bureau of Indian Affairs - Flathead Irrigation Project The purpose of this Amendment No. 1 is to: 1. remove the Indian Small Business Economic Enterprise (ISBEE) set aside; 2. add a Total Small Business Set aside under NAICS 325320, Pesticide and Other Agricultural Chemical Manufacturing, and small business size standard 1,000; 3. extend the due date for submission of quotes until April 13, 2021 at noon Pacific Daylight Time. 4. add the following instructions for submitting a quote: How to submit a quote: To be considered for award, you must provide the following: 1. Price (fill out the following: Quantity five (5) 275-gallon totes Line 0010 $____price per each 275-gallon tote, Nautique (or equal) aquatic herbicide, Total price: $_____ (Note: the proposed price must be inclusive of freight costs and any hazardous material fees/taxes, as well as pick up and disposal of the empty totes from the delivery location. Vendor will be allowed up to 6 months from date of award to pick up all used totes); 2. Product sheet showing the proposed brand name; if proposing an alternate brand other than Nautique, the product sheet you submit must show that all equivalent features listed above are met; 3. Fill out and return the attached document, 52.223-3, Hazardous Material Identification and Safety Data; 4. Provide evidence your company is authorized to distribute product proposed in line 0010;. NOTE: if you do not provide all of the requested information with your quote your quote will be determined not technically acceptable and will be removed from consideration for award. How your quote will be evaluated: Award shall be made to the responsible firm submitting the lowest priced, technically acceptable quote. If quotes cannot be determined reasonably priced, no award shall be made. Faxed and mailed quotes will not be accepted. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. All responsible sources may submit a bid, proposal, or quotation which shall be considered by the agency. The anticipated award date is on or around April 8, 2021. No Defense Priorities and Allocations System (DPAS) assigned rating applies to this solicitation. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2021-05 Effective March 10, 2021. Set Aside: This requirement is set aside 100% for Indian Small Business Economic Enterprises (ISBEEs). NAICS 325320, Pesticide and Other Agricultural Chemical Manufacturing, and small business size standard 1,000 employees applies. The full text of DIAR provision 1452.280-1 is shown below: DIAR clause 52.280-1 Notice of Indian small business economic enterprise set-aside. (JUL 2013): Under the Buy Indian Act, 25 U.S.C. 47, offers are solicited only from Indian economic enterprises (Subpart 1480.8) that are also small business concerns. Any acquisition resulting from this solicitation will be from such a concern. Offers received from enterprises that are not both Indian economic enterprises and small business concerns will not be considered and will be rejected. (End of provision) 52.211-6 Brand Name or Equal. (Aug 1999) (a) If an item in this solicitation is identified as 'brand name or equal,' the purchase description reflects the characteristics and level of quality that will satisfy the Government's needs. The salient physical, functional, or performance characteristics that 'equal' products must meet are specified in the solicitation. (b) To be considered for award, offers of 'equal' products, including 'equal' products of the brand name manufacturer, must- (1) Meet the salient physical, functional, or performance characteristic specified in this solicitation; (2) Clearly identify the item by- (i) Brand name, if any; and (ii) Make or model number; (3) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and (4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications. (c) The Contracting Officer will evaluate 'equal' products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer. (d) Unless the offeror clearly indicates in its offer that the product being offered is an 'equal' product, the offeror shall provide the brand name product referenced in the solicitation. (End of provision) Description of requirements for the items to be acquired: Nautique Aquatic Herbicide (or equivalent brand); If proposing other than the brand Nautique the product sheet submitted with your quote must demonstrate that all equivalent features are met. Equivalent features are as follows: 1. The proposed herbicide must be the 275-gallon size for ease of application; no other sized tote will be accepted; 2. Active ingredient must be: Copper ethylene diamine complex 13.2%; Copper triethanolamine complex, 14.9%; must treat aquatic weeds and algae including: must treat most all invasive species but particularly the following: SAGO PONDWEED, AMERICAN PONDWEED, WATERWEED, COONTAIL, ALGAE and be safe for bull trout.
