Description
1. Contracting Activity: Department of the Navy, Naval Facilities Engineering Command, Mid- Atlantic (NAVFAC MIDLANT), PWD Norfolk 2. Description of the Action Being Approved: Award of a 3-month extension to Contract N40085-16-D-2211, LEASE OF HIGH-QUALITY DEMINERALIZER WATER UNITS FOR NAVFAC MID-ATLANTIC PWD NAVAL STATION, NORFOLK, VA. The extension is necessary in order to perform complete pre-award activities and contract award. 3. Description of Supplies/Services: The Contractor shall furnish all labor, supervision, management, tools, materials, equipment, facilities, transportation, incidental engineering, and other items necessary to provide high quality demineralized water for the Norfolk Naval Station Utilities Department, Naval Station Norfolk, Virginia. That water service shall be provided by leasing mobile water purification equipment to the government through this contract, and maintaining that equipment. The Contractor will maintain ownership of all equipment provided to and operated by Government Forces. Equipment will be used mostly aboard Naval Station Norfolk. The equipment may also be used at other Naval Facilities throughout the tidewater area i.e. (Joint Base Little Creek / Fort Story, Naval weapons Station Yorktown, U.S. Naval activities in Newport News, and within a 50 mile radius of those locations.) Equipment will be operated and moved by Government Employees based on the Government�s requirements. The bridge will be for a 3 month base period with one (1) three (3) month bridge option. The base period of the bridge will be effective from 01 April 2021 to and including 30 June 2021 with an estimated value of $127,116. The three (3) month option, if exercised, will be effective 1 July 2021 to and including 30 September 2021 with an estimated value of $127,116. The total bridge amount if the option is exercised will be $193,212. 4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C. 2304(c)(2); FAR 6.302-2, Unusual and Compelling Urgency. Contracting without providing for full and open competition under this acquisition may be accomplished pursuant to the authority of 10 U.S.C 2304(c)(2) of the Federal Acquisition Regulation 6.302-2, Unusual and Compelling Urgency. The agency�s need for these services is of such an usual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive synopsis requirements pursuant to FAR 5.22(a)(2). 5. Rationale Justifying Use of Cited Statutory Authority: The authority cited in Section 4 is deemed appropriate due to the unusual and compelling need for mobile water demineralizer processing rental units at Naval Station Norfolk. Prior to the contract being assigned to PRW222 at PWD Norfolk, there were discussions on which office would solicit the contract. Immediately after being assigned to PRW222, market research was conducted in the form of Dynamic Small Business Search and Sources Sought Notice which was posted on Beta.SAM.gov. The Dynamic Small Business Search identified 7 small businesses registered under NAICS Code 221310. All 7 businesses were contacted via email and yielded zero (0) responses. The Sources Sought Notice was posted to beta.sam.gov for 18 days. The Sources Sought Notice also produced zero (0) interested bidders. After receiving zero interested small businesses, the current contract holder was contacted and expressed interest in bidding. The contract was then transferred to Facilities Support Contracts (FSC) CON31. FSC CON31 is currently reviewing the transferred documents while working on the MOPAS and the Source Selection Plan. There is not sufficient time to complete the solicitation process and award before the contract expires on 31 march 2021. 6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable. Due to the urgent need for continued services, it is not practical or in the best interest of the Government to solicit additional sources for the required services. The incumbent is currently mobilized at the site, is intimately familiar with the work to be performed, and is performing satisfactorily. 7. Determination of Fair and Reasonable Cost. The price was determined to be fair and reasonable prior to award, and pricing for this 3-month extension with one (1) three (3) month bridge option will remain the same pending a change in the SCA wage determination and/or the Collective Bargaining Agreements. 8. Actions to Remove Barriers to Future Competition. This is a one-time exception to full and open competition, which is dictated by the exigent attendant circumstances. The follow-on contract will be awarded based on full and open competition after exclusion of sources in accordance with FAR 6.204.
