- Fair Opportunity/Limited Sources Justification:� FAR 5.301 requires that contracting officers post their justifications on FBO whenever they make a delivery/task order award under a multiple-award IDV and do not provide for fair opportunity. USDA, Forest Service NRS 2.Description of supplies required to meet the agency�s needs Trimble Rangers and accessories 3.The circumstances and rationale for limiting competition. 8.405-6(a)(1)(i)(B). TRIMBLE has been the primary supplier for the agency. �8.405-6(a)(1)(i)(C). TRIMBLE is the only firm capable of providing the supplies�without the USDA Forest Service experiencing substantial duplication of cost that could not be expected to be recovered through competition and would result in unacceptable delays in fulfilling its requirements. Supplies are unique and highly specialized; this award is a logical follow-on order that represents the best value. �4. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted. Market research was not conducted; No other provider would be a feasible option, no other efforts were made to obtain competition. �FAR 8.405-6 Limited Source Justification with GSA: Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251 et seq.) and Title 40, U.S.C. 501, Services for Executive Agencies, are the two statutes that authorize the MAS program. The GSA Administrator has statutory authority to procure and supply personal property and nonpersonal services for use of the executive agencies in the proper discharge of their responsibilities, and perform functions related to procurement and supply. The statute states that the use of GSA Schedules is a competitive contracting procedure since participation in the program has been open to all responsible prospective contractors, and orders and contracts under such procedures result in the lowest overall cost alternative to meet the needs of the Government. [See FAR 8.404(a) and FAR 6.102(d).)]. The requirement for a synopsis is waived based upon FAR 5.202(11). (Also see 8.404(a)).
