Attachment 1: Streamlined Market Research Report VHAPM Part 810 Market Research SOP Page 1 of 3 Revision: 06, Effective Date: 12/10/20 Attachment 1: Streamlined Market Research Report Template 1 Requirement Title: Ophthalmic Slit Lamp Camera PR: 614-21-2-560-0076 In accordance with FAR 7.102, contracting officers and acquisition planners are required to perform acquisition planning and conduct market research. The following information is a summary of the acquisition planning: In submitting this request for procurement, the customer considered available sources within the agency, any government furnished information/property, and security considerations IAW VA Directive/Handbook 6500. The contract type for this procurement is firm-fixed-priced and the milestone schedule will be accomplished and documented in the Electronic Contract Management System (eCMS). The information below summarizes the market research results for this requirement. Objective: Per FAR 10.001(a)(2) and VAAR 810.001-70, this report is in support of (check as many as apply): A new requirement An acquisition with an estimated value in excess of the simplified acquisition threshold (see FAR subpart 2.1 for current threshold) An acquisition with an estimated value less than the simplified acquisition threshold where adequate information is not available to develop the requirements package and the circumstances justify the cost of performing the market research; An acquisition that could lead to a bundled contract (15 U.S.C. 644(e)(2)(A)) (see FAR subpart 2.1 for bundled contract definition); Other: Background: Title: Ophthalmic Slit Lamp Camera Product or Service Code: 6540 NAICS Code: 339112 Size Standard for NAICS: 1000 Estimated contract value: $35,799.25 Market Research Methods/Techniques/Sources: In accordance with FAR Part 10 and VAAR 810, market research has been conducted for this acquisition. The following techniques were used (Check all that apply and provide a narrative of the nature of the information obtained and the contact information identified for each reference checked below): and the timeframes/date of the research (check as many as apply): Used VA s VIP database to identify verified capable SDVOSBs and VOSBs. Vendor Information Portal VIP NAICS 339112 with a keyword Slip Lamp found a total of 8 results. None of which are authorized distributors. Applying personal knowledge in procuring supplies/services of this type. (Provide a narrative describing the nature of your personal knowledge): Contacting knowledgeable individuals in Government and industry regarding market capabilities to meet requirements. (Identify method and date of communication/POC name/title organization/e-mail/phone): Reviewing the results of recent market research undertaken to meet similar or identical requirements. (Cite Contract or Order number/period of performance/names of past contractors/prices paid/other information and date): 614A99028 $194,747.43 and 614A09029 $117,127.92 both have similar items but not identical. The items on those awards have on contract items. The item on this requirement has one minor change which is no longer makes this item available on ant already established contract. Publishing formal requests for information in appropriate technical or scientific journals or business publications. (Identify name of journal(s)/publication(s)/date published): Querying the Government-wide database of contracts and other procurement instruments intended for use by multiple agencies available at www.contractdirectory.gov and other Government and commercial databases that provide information relevant to agency acquisitions. (Identify URL of database(s)/name of procurement instrument(s) identified): Search of the Medical supply Share point Contract list with a keyword search resulted in finding 2 vendors. Neither of the vendors are authorized distributors. Participating in interactive, on-line communication among industry, acquisition personnel, and customers. (Identify POC name/title organization/e-mail/phone/description of the nature of the forum): Obtaining source lists of similar items from other contracting activities or agencies, trade associations or other sources. (Identify POC name/title organization/e-mail/phone and the resultant source list): Reviewing catalogs and other generally available product literature published by manufacturers, distributors, and dealers or available on-line. (Identify catalog and/or product literature): Searched the National Catalog data base and GSA. The search resulted in 23 vendors under GSA, and 2 vendors under the National Catalog data base. There were no vendors that were covered under the authorized distributors of the manufacture. Conducting interchange meetings or holding presolicitation conferences to involve potential offerors early in the acquisition process. (Identify nature of interchange / date / location / list of attendees by name, title, organization, e-mail, and phone): Conducting market survey: Other: Market Research Findings VA Rule of Two not met. Past experience with this type of procurement found the aforementioned SDVOSBs to be pass-through vendors by not meeting the proper Small Business Administration (SBA) definition of a nonmanufacturer with regard to the element of taking possession or ownership through personnel, equipment, or facility the products requested in this procurement. Also, this is a brand name requirement from a large business manufacturer. Procurement value is below the SAT where the SBA s nonmanufacturer rule (NMR) does not apply to small business set-aside or sole source action; however, it does apply to SDVOSB/VOSB set-aside or sole source actions, unless there is an SBA NMR Class Waiver in effect. There is no SBA Class Waiver in effect for NAICS 339112, PSC/FSC 6540, and description related to ophthalmic equipment or instruments. Per VA Policy Flash 17-14, Strategic Sourcing Contract Support, VA s contracting Officers should support VA s Strategic Sourcing Program by utilizing the national contracting organizations of the NAC, SAC, DLAC, and TAC to the maximum extent practicable. This does not apply as this item is not found on any established contracts. VA Directive 7408.1, Requesting Waivers from the Requirement to Use VA Federal Supply Schedules (FSS) dated 6/09/2005 is still in effect. No justification for waiver from use of FSS was found. Customary Commercial Practices/Standards The researched slit lamp imaging systems all met minimum service industry standards related to ophthalmic equipment, including cleaning and disinfection. Market Price: $ 35,799.25 Acquisition History: Both 614A99028 and 614A09029 were awarded in the past and consist of similar items. All pricing indicates that the requirement is considered fair and reasonable. Other pertinent information: Haag-Streit s web page indicated that there are only 3 authorized distributors in North America. Of those 3 authorized distributors there is only 1 that is in SAM. I reached out to all 3 to see if they could provide a quote and to see if they would be interested in registering in SAM. The one that was already in SAM (Haag-Streit USA, Inc. DUNs# 177652310) is the only one that provided a quote. This requirement will be completed as a sole source requirement. Based on the above information, the basic clauses and provisions prescribed in FAR Part 12: Are sufficient for use in this acquisition and do not require any tailoring to be consistent with industry's commercial practices. Require tailoring to be consistent with industry's commercial practices as noted below. All such tailoring will be included in the solicitation issued for the required supplies/services. - Identify affected clause/provision paragraph and your recommended change(s). This recommendation will stand alone as the sole acquisition strategy document for Large business determination for informal acquisition planning to vendor Haag-Streit USA, Inc.
