- NOTICE OF INTENT TO SOLE SOURCE Contracting Opportunities Announcement Type: Special Notice Announcement Number: NIST-NOI-21-01773 Subject: MPACT/ANLAP software license renewal Introduction This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested. Purpose The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with the Multi Physics Adaptive Computer Technology (MPACT), Corp. located at 5792 Oak Bend Lane, Unit 105, Oak Park, CA 91377. The purchase order will specifically procure a 12-month lease of the MPACT System and ANLAP software license renewal. The MPACT and ANLAP software licenses shall be delivered electronically and be effective from date of award through 5/31/2022 allowing the Applied and Computational Mathematics Division (ACMD) in the Information Technology Laboratory (ITL) at NIST to continue progress on various research projects. Authority This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 511210 � Software Publishers, with a small business size standard of $41.5 million. Description Please see the attached Statement of Need/Required Specifications document for details.� Sole Source Determination The sole source determination is based on the following:� The ACMD at NIST requires a renewal of the MPACT/ANLAP software licenses, an advanced nonlinear FEM software for Multiphysics problems, due to continuity of science and compatibility with previous research results. This software has been used on previous and existing research projects and has allowed NIST to generate uncertainty analysis codes that require a renewal of the licenses to regenerate using the same algorithms and codes of the software. The required software is proprietary to its original manufacturer and is not available from any other contractor. Information for Interested Parties Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice. This notice of intent is not a solicitation.� Any questions regarding this notice must be submitted in writing via email to Hunter Tjugum, Contract Specialist, at Hunter.Tjugum@nist.gov. All responses to this notice of intent must be submitted via email to hunter.tjugum@nist.gov so that they are received no later than June 8, 2021 at 12:00 PM, Eastern Time.
