INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institute on Drug Abuse (NIDA), Office of Acquisitions intends to solicit by a request for quotation from FEI Company for award on or around June 26, 2021. The purpose of this acquisition will be to provide the National Institute on Drug Abuse (NIDA) with maintenance and repair services for the FEI Tecnai12BT Transmission Electron Microscope (Serial No. D347) currently in use by the Confocal and Electron Microscopy Core (CEMC), National Institute on Drug Abuse � Intramural Research Program. NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE and SET ASIDE STATUS The intended procurement is classified under NAICS code 811219 with a Size Standard of $22 Million. This acquisition is NOT set aside for small businesses. REGULATORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13�Simplified Acquisition Procedures. Contracts awarded using FAR Part 13�Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6�Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization). The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2020-01 dated November 12, 2019. DESCRIPTION OF REQUIREMENT PURPOSE AND OBJECTIVES: The purpose of this requirement is to provide the National Institute on Drug Abuse � Intramural Research Program, Confocal and Electron Microscopy Core (CEMC) (NIDA-IRP) with maintenance and repair services for the FEI Tecnai12BT Transmission Electron Microscope. The NIDA-IRP Confocal and Electron Microscopy Core (CEMC) serves NIDA-IRP researchers by providing access to existing and emerging techniques for neuronal ultrastructural analysis. The NIDA-IRP CEMC offers the following services: (1) EM services that are tailored to the needs of individual IRP researchers. Services include sectioning, immunostaining and counterstaining, and EM imaging; and (2) training and access to an ultrathin microtome and a transmission electron microscope, and data interpretation. Close cooperation and participation with NIDA investigators is critical to the success the EM Core. For the success of the NIDA-IRP Confocal and Electron Microscopy Core, the Tecnai12BT Transmission Electron Microscope must be serviced throughout the year. The objective of this acquisition is to provide NIDA-NRB with maintenance and repair services to support the operation of the MRI scanner and ensure continued high-quality imaging performance of the scanner to support research in drug addiction. PROJECT REQUIREMENTS: The Contractor shall provide preventative maintenance and on-demand repair services for the Tecnai12BT Transmission Electron Microscope (Serial No. D347). Requirements include: ��� instrument software updates ��� preventative maintenance inspections, including one (1) planned PM/year ��� technical telephone consulting available during normal business hours ��� unlimited on-site service visits when requested Contractor shall schedule and perform on-site preventative maintenance from 8:00am � 5:00pm Monday through Friday, excluding Federal holidays. Due to the critical nature of these units the contractor must ensure the following: The contractor shall make commercially reasonable efforts to obtain any required part within the targeted 48 hours of the service technician assessment. To ensure continuity of science and continued full function of owned proprietary equipment, only a Tecnai 12BT Transmission Electron Microscope is acceptable. The service technicians need to be factory certified. All services provided under the Service Agreement will be performed in a workmanlike manner. Subject to the terms of the Service Agreement, all labor, replacement parts or components (excluding consumable) provided by will be guaranteed for a period of ninety (90) days from the visit completion date. The contractor�s obligation for breach of warranty shall be to (a) use commercially reasonable efforts to perform the services in a manner that conforms with the warranty, or replace the replacement parts or components as the case may be, (b) refund to NIDA the pro-rata portion of the fees paid to the contractor allocated to the nonconforming services or replacement parts or components. Contractor shall have access to proprietary parts and test instrumentation for effective repair in case of malfunction. Technical performance requirements include system coverage on the subject equipment by Original Equipment Manufacturer (OEM) factory-trained, authorized technicians and providers of any required parts and software or proprietary diagnostic software and software enhancements must be OEM certified (new or like-new) and compatible with the subject equipment. Contractor shall be required to provide written progress reports in achieving this statement of work during the period of performance. The original documentation shall be provided by the vendor to show they completed service on the instrument and should document technical progress with the POC. Service shall include labor and parts coverage, on-site labor response, technical telephone response (call-back to schedule), planned maintenance, and preferred labor rate. � CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. Specifically, Thermo Fischer Scientific verified that its subsidiary FEI Company was the only entity authorized to perform maintenance services and provide factory reconditioned parts for the subject equipment. As such, FEI Company is the only entity authorized to provide preventative maintenance and on-demand repair services for the Tecnai12BT Transmission Electron Microscope (Serial No. D347). Because this request is to provide preventative maintenance and on-demand repair services for the Tecnai12BT Transmission Electron Microscope currently housed in NIDAIRP�s Biomedical Research Center, there is currently only one commercial source available: FEI Company. The intended source is: FEI Company 5350 NE Dawson Creek DR Hillsboro, OR 97124-5793 United States of America CLOSING STATEMENT THIS SYNOPSIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. However, interested parties may identify their interest and capability to respond to this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. All responsible sources may submit a capability statement, proposal, or quotation which shall be considered by the agency. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include: unit price, list price, shipping and handling costs, the delivery period after contract award, the prompt payment discount terms, the F.O.B. Point (Destination or Origin), the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. All responses must be received by the closing date and time of this announcement and must reference the solicitation number, 75N95021Q00214.
