- INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The National Institutes of Health (NIH), Clinical Center (CC), Office of Purchasing and Contracts (OPC) on behalf of the Center for Cellular Engineering (CCE), Clinical Center (CC) at the National Institutes of Health (NIH) intends to negotiate and award a contract without providing for full and open competition (including brand-name) to: BIO-RAD LABORATORIES, INC. 2000 ALFRED NOBEL DR HERCULES, CA, 94547-1804 USA NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 325413 with a Size Standard 1250. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) 2021-05 March 10, 2021. This acquisition is conducted under the procedures as prescribed in FAR subpart 13-Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13-Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold. Contracts awarded using FAR Part 13-Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6-Competition Requirements. GENERAL INFORMATION 1. Title: Bio-Rad Lab., Inc./ various reagents Base + 2 Option Years. 2. Background Information: �The National Institutes of Health (NIH) Immunoassay Lab is managed by the NIH Clinical Center Department of Laboratory Medicine (CC/DLM). The NIH Immunoassay laboratory is responsible for clinical diagnostic infectious disease testing for patient care and research protocols. The clinical research applications place a high demand for analytical accuracy and precision and the volume of testing per patient is considerably higher than in routine clinical practice.� The Immunoassay Lab currently provides services for 35 protocols across several Institutes, and they all require highly accurate and rapid results. In addition, some research protocols extend over several years, it is very important for laboratory values to remain consistent over time through the same testing methodologies and similar instrumentation. The NIH Immunoassay laboratory is accredited by the College of American Pathologists.� The accreditation was obtained thru the use of the controls from this vendor. These Immunoassay testing controls are used by the Immunoassay Lab for routine and specialized testing of all patients and research samples.� Without these controls, the Immunoassay Lab testing procedures would halt. The Immunoassay Lab requires the Bio-Rad control material because it contains the specific analytes at concentrations that span the range of each of our tests.� 3. Purpose or Objective: To procure the various reagents due to the needs of the Immunoassay Lab in the Department of Laboratory Medicine (DLM) at the NIH Clinical Center in relation to various controls needed.� The contract will enable the Immunoassay Lab to obtain testing controls for cardiac, cancer and infectious disease markers from the vendor in a streamlined manner and will enable the Immunoassay Lab to provide consistent, high quality results for clinical center patients.� 4. Period of Performance: �Base 7/31/21 � 7/30/22. ���������������������������� ������� OPT YR 1: Base 7/31/22 � 7/30/23. ���������������������������� ������� OPT YR 2: Base 7/31/23 � 7/30/24. CONTRACTOR REQUIREMENTS (SCOPE OF WORK) 1. Objectives The controls requested are listed below, and will be shipped to the Immunoassay Lab within 5 business days of a request being made.� Controls will be ordered on an �as needed� basis.� Approximate numbers to be ordered are listed but are not to be considered absolute.� The number of each control type may vary based on the needs of the lab. 1.1 Special Requirements Controls will be shipped on dry ice if necessary and shipped overnight to ensure the integrity of the reagents. The vendor will lot reserve Quality Control material. 1.2 Reporting Requirements and Deliverables Reagents will be delivered according to need.� Volumes indicated on the quote/IGCE are for estimated used ONLY- there is no requirement to purchase a predetermined number of any kit/control. Orders will be placed by Paulina Stallcup on an �as needed� schedule. Controls must be provided within 5 business days of order placement. The Immunoassay Lab accepts that the reagents may not be available within the 5 day window during holiday periods.� If a break in service is expected, the vendor will notify the Immunoassay Lab no less than one week prior to that time. 1.3 Inspection and Acceptance Requirements When received, orders will be accepted by Paulina Stallcup. Correct shipping conditions and packaging integrity will be verified prior to acceptance of the shipment. Shipment of the correct lot numbers will be verified prior to acceptance of the shipment. Any discrepancy with the order will be addressed with the vendor sales representative within in 1 week of receipt. 1.4�������� Logistical Requirements The Immunoassay Lab accepts that controls may not be available within the 5 day window during holiday periods.� If a break is service is expected, the vendor will notify the Immunoassay Lab no less than one week prior to that time. All materials will be delivered to the Chemistry/Immunoassay Lab Bldg. 10 Room 2C326 9000 Rockville Pike Bethesda, MD 20892 Deliveries are 8am to 4pm EST and must be signed for CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME) DETERMINATION This system is on site and has been validated for use on CC patients.� It would be detrimental to the government to attempt to change systems and quite impossible as these instruments are proprietary and only distributed by Lonza Walkersville, Inc. �With the continuation of using the same system will also help reduces the risk of a disruption in patient care. The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10-Market Research. CLOSING STATEMENT This synopsis is not a request for competitive proposals. However, interested parties may identify their interest and capability to respond to this notice. Responses to this notice shall contain sufficient information to establish the interested parties' bona-fide capabilities for fulfilling the requirement and include a technical proposal, a cost-price proposal, and the period of performance, the Dun & Bradstreet Number (DUNS), the Taxpayer Identification Number (TIN), and the certification of business size. All offerors must have an active registration in the System for Award Management (SAM) www.sam.gov. � A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. The information received will normally be considered solely for the purposes of determining whether to proceed on a non-competitive basis or to conduct a competitive procurement. All responses must be received by May 31th, 2020, 1:00 PM Eastern time and must reference solicitation number 21-006476.
