- INTENT TO SOLE SOURCE NGR Bankruptcy Data #SS-OFR-21-086 The Bureau of Fiscal Service (Fiscal Service), on behalf of The Office of Financial Research (OFR) and the Financial Stability Oversight Council (FSOC), intends to contract with New Generation Research, Inc. (DBA The Turnaround Letter), 88 Broad Street, Floor 2, Boston, MA 02110-3403, on a sole source basis for NGR BankruptcyData Databases. There is no competitive vendor or regulatory agency that provides these datasets. The proposed Contractor developed and owns the propriety and patented software, algorithms, and work efforts that are used in these products and support the services specifically required for this acquisition; thereby, the proposed source has the sole unique technical and other resources required for this acquisition. As a joint effort with the White House Council of Economic Advisors, the OFR to is required to research the rising number of corporate defaults and bankruptcies in the wake of the COVID-19 pandemic event.� The OFR requires current and historical bankruptcy data sourced from at least ninety (90) U.S. bankruptcy courts beginning at least from the year 2000.� Data must report on a continual weekly basis the public companies currently operating under Chapter 11 protection as well as all companies with at least $50 million in assets or liabilities.� Information on reported companies must at a minimum include: plans of reorganization and disclosure statements; debtor-in-possession financing information; professional retention data; 363 sales motions; key employee incentive plans; monthly operating reports; claim transfer activity; securities and security pricing data; and committee information. Proposed databases must compile case information for all companies that file for bankruptcy in the 94 U.S. Bankruptcy Courts in near-real time. The database must also allow users to filter and aggregate business bankruptcy filings by small, mid, and large size companies and to filter by filing type (Ch 7, 11, 12, 13). Additionally, the proposed database must provide an automated option to conduct sector/industry analysis or company size analysis. The platform must also allow subscribers to determine extensive details pertaining to individual bankruptcies, to identify a group of companies that meet specific criteria, and to stay abreast of the bankruptcies with a range of sectors. Data provided must allow for filtering and searching such that individual bankruptcies as well as groups of companies meeting specific criteria within a range of sectors is possible.� Data must be deliverable by an API, data feed, or retrieval by FTP (e.g. through an Amazon Web Services bucket), and the user must be able to receive data daily, weekly, or monthly. Finally, any proposed database must: stream dockets from the U.S. Bankruptcy Court for all business bankruptcy filings; assist subscribers in monitoring bankruptcy cases by writing about significant and actionable events for �priority� cases (companies with public equity or debt, with particularly high profiles, or with liabilities in excess of 50MM USD); provide a research platform where subscribers can query and export data from our robust database of business bankruptcy filing information; supply?professional retention data, including rates and final fees; and serve as the �hub� of business bankruptcy information that bankruptcy professionals have?trusted and relied upon since 1986. The proposed contractor developed and owns the propriety and patented software, data processes, and work efforts that are used in these products and support the services specifically required for this acquisition; thereby, the proposed source has the sole unique technical and other resources required for this acquisition. The period of performance for the purchase order is anticipated to be one (1) twelve-month base period and three (3) option periods of twelve (12) months each. The total estimated value of this purchase order will not exceed the simplified acquisition threshold. NO SOLICITATION IS AVAILABLE. �A request for more information, or a copy of the solicitation, will not be considered an affirmative response to this Special Notice. Telephone responses or inquiries to this Special Notice will not be accepted. Fiscal Service will consider written responses received no later than 06/17/2021. Responses must include sufficient evidence that clearly shows your company is capable of providing the content described in this notice. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. If no written response is received by the aforementioned deadline that clearly demonstrates an ability to meet all requirements and is more advantageous to the Government, Fiscal Service will make award on a sole source basis to Ice Data Pricing & Reference Data LLC. Qualified Contractors must provide the following: 1. The name and location of your company, contact information, and identify your business size (Large Business, Small Business, Disadvantaged Business, 8(a), Service Disabled Veteran Owned Small Business, HUBZone, etc.).� Please ensure contact information includes the name of the point of contact, email address, and telephone number, should the Government have questions regarding individual responses. 2. DUNS Number. 3. Specific details of the product(s) that your company offers in regards to this notice. 4. Whether your content is available through a Government contract vehicle or Open Market. 5. A brief capabilities statement (not to exceed 5 pages) that includes a description of your company's standard line of business, as well as a list of customers to whom your company currently provides the specific required content. Additionally, a sample size of the data may be requested if it is determined to be an equal to the above provided information.� Failure to provide any of the requested items above will constitute a non-responsive submission and will not be considered. The following file extensions are not allowable and application materials/data submitted with these extensions cannot be considered: .bat, .cmd, .com, .exe, .pif, .rar, .scr, .vbs, .hta, .cpl, and .zip files. Microsoft Office and Adobe compatible documents are acceptable. No other information regarding this Special Notice will be provided at this time. The period of performance for the purchase order is anticipated to be one (1) twelve-month base period and three (3) option periods of twelve (12) months each after receipt of order (ARO).� Fiscal Service may consider information� received no later than 12:00 p.m. EST on Thursday, June 17, 2021, submitted to purchasing@fiscal.treasury.gov, BankruptcyData / Attn: CW - ED.
