- Synopsis: The Department of Veterans Affairs, Program Contracting Activity Central, St. Louis (PCAC) Office, intends to award a sole source commercial purchase order in accordance with FAR Parts 12 & 13. The North America Industry Classification System Code [NAICS] is 811219 Other Electronic and Precision Equipment Repair and Maintenance and the size standard is $22 Million. The government has determined that Eaton Corporation is the only source that can satisfy this agency requirement. The requirement is for a B56 Eaton Uninterruptible Power Supply (UPS) Unit Maintenance Service Level Agreement and turnkey replacement service of the batteries in the two VA-owned Eaton model 9390-100-160 UPS with serial numbers EK211CBC01 and EK206CBC10. All responsible sources may submit a response, which if timely received, will be considered by The Department of Veterans Affairs, PCAC St. Louis Office. This synopsis is for notification purposes only and does not constitute a solicitation for bids or proposals. Any company that feels they have items that meet the needs of the Government must submit their technical data (2 pages or less) to support their claim. The information must explain the company's ability to overcome propriety information. The Government does not intend to pay for any information provided under this synopsis. The current Eaton UPS batteries have reached the maximum lifecycle of service and need a full refresh and install. Eaton shall provide resources required to deliver, install, commission, and confirm proper operation of 80 UPS batteries. Furthermore, the letter states that Eaton does not train, certify or support independent third-party service providers to deliver or service its equipment. As such, this limits availability of the required commodity and service to only one source and no other vendor can be used. Order Against FSS: Authority of the Multiple Award Schedule Program, Title III of the Federal Property and Administrative Services Act of 1949 (41 USC 251, et seq.); Title 40 USC 501, Services for Executive Agencies; and Section 803 of the National Defense Authorization Act of 2002 (PL 107-107) and implemented by FAR 8.405-6. Applicable exception: Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer (FAR 8.405-6(b)). 4. Description of market research conducted and results or statement why it was not conducted: EES contacted the OEM to determine if they allowed other vendors to provide the SLA maintenance for their UPS units. This market research attempt resulted in the OEM POC providing a letter (P02_ATTCH1_UPS SLA_21BC-S18) that states Eaton is the OEM of the equipment to be maintained and that Eaton is the only authorized provider of support service. Furthermore, the letter states that Eaton does not train, certify or support independent third-party service providers to deliver or service its equipment. Additionally, no other service provider is authorized to possess Eaton proprietary (copyrighted) software, repair documentation, processes or materials. Without proper maintenance of the UPS system, EES broadcasting services would be vulnerable to any interruption of power or power outage, rendering the EES unable to continue operations that support the VHA s healthcare providers with an employee education platform for those serving our nation s Veterans.
