- NOTICE OF INTENT TO AWARD OUT-OF-SCOPE MODIFICATION In accordance with Federal Acquisition Regulation 16.505((b)(2)(ii)(A) Exceptions to the fair opportunity process, the Department of Veterans Affairs (VA), Veterans Health Administration (VHA) Network Contracting Office (NCO) 23, intends to award Modification P00009 against task order VA263-17-J-0804 which is not within scope of the original contract, which is Project 437-13-111 titled Upgrade HVAC-Phase One, to MDM Construction, LLC located at 2215 Sheyenne Street, West Fargo, ND 58078. The purpose of the modification is the contractor includes all work to revise the HVAC ductwork, the roofing work, testing and balancing of the AHUs, removal and replacement of LIT ceilings for work above, removal and replacement of all old duct insulation, revision work for the Building Automation System and all work for patching and repair by the General Contractor. The Contractors proposal for all work to revise the outside/fresh air intakes is an ADD of $140,028.46 with no additional days requested as this work will be conducted simultaneously with the work in Modification P00008. The associated North American Industry Classification System Code is 236220, Commercial and Institutional Building Construction with a size standard of $39.5 Million. This notice of intent is not a solicitation or request for competitive quotes. No solicitation package is available. A determination not to compete this requirement is solely within the discretion of the U.S. Government. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the Agency. Any capability statement, proposal, or quote provided shall be at no cost or obligation to the U.S. Government. Responses must be received no later than 4 p.m. Central Standard Time on Friday June 25, 2021. All responses shall be submitted to Jennifer Johnson via email at Jen.Johnson@va.gov.
