Description
The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Region Acquisitions Division-Kansas City office intends to award, on a sole source basis, under the authority of FAR 13.106(b)(1), with Transfinite Systems Limited, located in the United Kingdom, a purchase order for a base�and two option years for Visualyse Software Maintenance Renewal. The Government intends to utilize the authority under the Federal Acquisition Regulation (FAR) 13.106-1(b)(1), Only One Responsible Source and No Other Supplies or Services will statisfy agency requirements, unless, as a result of this announcement, acceptable responses to this notice are received and a determination is made by the Government to issue a competitive solicitation. The Government intends to award a purchase order to Transfinite Systems Limited in the United Kingdom. Sole Source Justification: Each software support contract provides for yearly updates of the software and allows unlimited assistance in the usage of Visualyse Professional 7 and Visulayse Professional 7 modules. Visualyse Professional software and its modules are used by the NWS to simulate complex radio spectrum interference scenarios to justify and defend U. S. Government�s usage of the electromagnetic spectrum, both domestically and to the world community at International Telecommunication Union (ITU) assemblies. Due to the importance of defending current RF spectrum allocations, for the proper operation of expensive-to-replace-or- modify government systems like the NWS Next Generation Radar (NEXRAD), and the international scrutiny of U.S. RF spectrum usage requests, Transfinite support is critical to ensure the accuracy of Visualyse-generated simulations. Visualyse and its modules are proprietary software of the Transfinite Systems Ltd, Surrey, U.K. Only Transfinite can legally provide updates to Visulayse products. As of this procurement effort, Transfinite is the only product-developer-sanctioned provider of Visualyse support and training. Transfinite support has enabled the successful simulations that assisted in defending NOAA RF spectrum allocations at ITU conferences. Although Visualyse is a proprietary product of Transfinite, with currently no Transfinite sanctioned subcontractors that can provide modifications, and is currently the standard simulation software used for ITU work, NWS/OPPSD needs the Transfinite support contract to maintain and modify OPPSD-written RF interference simulations, created over the last ten years with Visualyse software. Defending the RF spectrum allocations that previously required simulations, using Transfinite�s Visualyse software, is an ongoing process. Additionally, new and related spectrum defense issues may be most cost-effectively�simulated by modifying a previously OPPSD-developed Visualyse simulation, then using an equivalent competitor�s product, should such a product become available in the near future. This special notice is not a request for competitive offerors and no solicitation package is available. However, firms that believe they can provide this service may submit substantiating documentation in writing within fifteen business days of this notice. Responses can be sent via e-mail to Abigail.green@noaa.gov. Documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice. If no documentation is received, award will be made directly to Transfinite Systems Limited. DOC, Eastern Region Acquisition Division requires that all contractors doing business with this office be registered with the System for Award Management (SAM).
