Description
1. Offerors are hereby notified that this Amendment is issued to extend the closing date and time for receipt of proposals under Solicitation SPE601-21-R-0303 TO: 23 June 2021 at 1:00 PM Central Daylight Time (CDT) for the following locations and soliciatation line numbers: a. Buckley AFB, CO, (Sol# 0108, 0116-0119) b. Peterson AFB, CO, (Sol# 0079, 0083-0086) c. Great Falls, MT, (Sol# 0003, 0016-0019) d. Wyoming ANG, WY (Sol# 0114, 0138-0141) e. Scott AFB, IL (Sol# 0106, 0111, 0128-0130) f. Peoria ANG, IL (Sol# 0049, 0054-0057) 2. Clarification of Government requirements should be requested by the Offeror by submitting questions and/or comments not later than 21 June 2021 by 1:00 PM CDT, to the Contracting Officer, Tammie Campbell via email at: Tammie.Campbell@dla.mil . 3. The following 52.212-4 Contract Terms and Conditions-Commercial Items (Oct 2018) clause is hereby amended: (f) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence such as, acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. Shall also include any accident, explosion, governmental law, ordinance, rule or regulation, whether valid or invalid, extraordinary failure of equipment or apparatus, inability to obtain electricity or other type of energy, feedstock, raw or finished material from normal sources of supply, labor, equipment or transportation, or any similar or different contingency beyond its reasonable control which would prevent or delay performance or make performance commercially impracticable whether or not the contingency is of the same class as those enumerated above, it being expressly agreed that such enumeration is non-exclusive. In the event any such contingency affects only a part of Contractor's capability to produce and/or deliver Product, Contractor will allocate production and/or deliveries among the requirements of all its affected customers and Contractor's own requirements in a fair and reasonable manner. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence. (h) Patent indemnity. Deleted. (o) Warranty. The items delivered hereunder will meet the specifications outlined in MIL-PRF-27210J and Commercial Item Description (CID) A-A595003D. The Government may reject any item which does not meet the specifications and no charge will be made for the item so rejected. No claim of any kind with respect to the conformance of items to the foregoing specifications, whether or not based on negligence, warranty, strict liability or any other theory of law, will be greater than the price of the quantity of nonconforming item(s) in respect to which such claim is made. The foregoing constitutes the Government�s exclusive remedy and the Contractor�s sole obligation with respect to any such claim. The Contractor does not make any other express warranty regarding products delivered under this contract. In relation to all other items or services delivered hereunder the Contractor confirms they will meet the specifications under the terms of this contract. (p) Limitation of liability.The Contractor will not be liable to the Government for any incidental, consequential, indirect, special or exemplary damages (including lost profits, sales, loss of business, economic loss, production or other similar damages) arising in connection with this contract without regard to the nature of the claim or the underlying theory or cause of action (whether in contract, tort, strict liability, equity or any other theory of law) on which such damages are based. The Contractor does not assume any responsibility for the suitability and the results of using the items alone or in combination with other articles or substances and in any manufacturing, medical, or other process or procedures. 4. Potential offerors shall sign the SF-30 amendment (block 15a-c) and acknowledge the solicitation/amendment(s)and submit with their prospective submitted proposals if applicable, not later than 23 June 2021 by 1:00 PM CDT, to the Contracting Officer, Tammie Campbell via email at: Tammie.Campbell@dla.mil.��EMAIL SUBJECT LINE: Midwest Region 9.1C, Solicitation SPE601-21-R-0303, Amendment 0004 5. Except as provided in this Amendment, all other provisions and terms of Solicitation SPE601-21-R-0303 remain unchanged. �
