NOTICE OF INTENT TO SOLE SOURCE Maintenance Support for Mastersizer 3000 Particle Size Analyzer Announcement Type: Special Notice Announcement Number: NIST-NOI-21-73-01945 PSC Code: J066 - Maintenance, Repair, and Rebuilding of Equipment- Instruments and Laboratory Equipment Subject: Maintenance Support for Mastersizer 3000 Particle Size Analyzer � Introduction This is a notice of intent, not a request for a quotation. A solicitation document will not be issued and quotations will not be requested. Purpose The National Institute of Standards and Technology (NIST) intends to negotiate a firm-fixed priced purchase order on a sole source basis with Malvern Panalytical, Inc. located at 2400 Computer Drive, Westborough, Massachusetts 01581-1887. The purchase order will be for maintenance support for a Mastersizer 3000 Particle Size Analyzer for a one-year base period and up to four one-year option periods. Authority This acquisition is being conducted under the authority of FAR Subpart 13.106(b)(1) allowing the Contracting Officer (CO) to solicit from one source. The North American Industry Classification System (NAICS) code for this acquisition is 811219 � Other Electronic and Precision Equipment Repair and Maintenance with a size standard of $22 Million. Description Please see the attached Statement of Work for details. Sole Source Determination The sole source determination is based on the following: � NIST owns and operates a Mastersizer 3000 Particle Size Analyzer which is proprietary to its original equipment manufacturer (OEM), Malvern Panalytical, Inc. The machine is used for experimental and computational materials science research. In order to maintain the schedule of, and accurately report results of, on-going research the machine must be maintained to OEM specifications, inclusive of hardware and software updates as well as repairs. Maintenance for the Mastersizer 30000 may only be procured from the OEM, Malvern Panalytical, Inc. No other contractor has the capability or authorization to service the proprietary equipment. Additionally, NIST must ensure that the machine continues to operate exactly to manufacturer specification for continuity of on-going scientific research. Accordingly, Malvern Panalytical, Inc. is the only contractor capable of addressing the Government's needs for this requirement. � Information for Interested Parties Interested parties that believe they could satisfy the requirements listed above for NIST may clearly and unambiguously identify their capability to do so in writing by or before the response date for this notice. This notice of intent is not a solicitation. Any questions regarding this notice must be submitted in writing via email to Ms. Lauren Roller, Contract Specialist, at Lauren.Roller@nist.gov.
