- Description
- Army Contracting Command - Detroit Arsenal (ACC-DTA) intends to negotiate a new seven-year Firm Fixed Price (FFP) requirements contract, inclusive of five base ordering years and two option ordering years,�solely with Troxler Electronic Laboratories, Inc. (Troxler) of Durham, North Carolina for a sustainment repair program of US Army owned Combat Engineer Tester, Construction, Materials, Moisture and Density (TCMMD). This action supports the sustainment repair program for US Army owned TCMMDs fielded to engineering construction units within the Continental United States (CONUS). During performance of this action,�the contractor�will be required to provide repair services and ancillary hardware to include core recalibration of TCMMDs, repair parts, parts support labor, emergency assistance, disposal, and transportation of TCMMDs to and from the Army�s storage location and the�contractor's repair facility. The contractor will be required to return all components, Basic Issue Items (BII), subassemblies, and systems to a Full Mission Capable (FMC) status, meeting all performance requirements which they were originally designed. A total of 69 TCMMDs are expected to be repaired over the life of the contract. This action will be a new solicitation under solicitation W56HZV-20-Q-0070. The statutory authority permitting other than full and open competition is 10 U.S.C 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1, �Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.� Specifically, FAR 6.302-1(a)(2)(ii)(A) and FAR 6.302-1(a)(2)(iii)(A) for DoD, Supplies and Services may be deemed to be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition.
