- VHAPM Part 808.405-6 Limiting Sources Attachment 2: Request for Limited Sources Justification Format >SAT VHAPM Part 808.405-6 Limiting Sources Page 1 of 4 Original Date: 08/30/2017 Revision 03 Eff Date: 03/18/2021 LIMITED SOURCES JUSTIFICATION ORDER >SAT FAR PART 8.405-6 Acquisition Plan Action ID: 36C250-21-AP-3774 (1) Contracting Activity: Department of Veterans Affairs, VISN 10, VA Ann Arbor Healthcare System, 506-21-3-118-0236 (2) Description of Action: This acquisition is conducted under the authority of the Multiple-Award Schedule Program (41 U.S.C. 152(3) and 40 U.S.C. 501). New requirement. Order against: FSS Contract Number: V797D-30111 Name of Proposed Contractor: Omnicell, Inc. Street Address: 1201 Charleston Road City, State, Zip: Mountain View, CA 94043 Phone: 817-239-0308 (3) Description of Supplies or Services: The VA Ann Arbor Medical Center Inpatient Pharmacy is requesting to purchase two (2) Omnicell Carousels and six (6) Central Pharmacy Manager AIO s along with the other items listed below. This justification and approval will enable Ann Arbor Medical Center to purchase and pay for the equipment for Pharmacy services. It will also include support services for twelve (12) months. (4) Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor s unique qualifications to provide the required supply or service. FAR 8.405-6(a)(1)(A): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays: FAR 8.405-6(a)(1)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; Omnicell is sole manufacturer and exclusive provider of their products and support services for the equipment in the U.S. They do not have authorized personnel outside of their company to provide the required products and/or services or this procurement. They do not contract products or services to 3rd parties; therefore, there are no other sources capable of meeting this request. FAR 8.405-6(a)(1)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures. FAR 8.405-6(b): Items peculiar to one manufacturer: A patent, copyright or proprietary data limits competition. The proprietary data is: These are direct replacements parts/components for existing equipment. The material/service must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. (5) Describe Why You Believe the Order Represents the Best Value consistent with FAR 8.404(d) to aid the contracting officer in making this best value determination: Presently, the Ann Arbor VA has many different pieces of Omnicell equipment in over 30 areas of coverage including in/outpatient pharmacies, and CBOCS and they are strategically housed on the nursing wards. There is already a server in place for all Omnicell units as well. The additional components would logically adapt to the current units. Omnicell has profoundly proven itself to be compatible with VISTA and CPRS without difficulty. The VA Ann Arbor Medical Center Inpatient Pharmacy would benefit from an efficient and streamlined inventory management workflow. This initiative aims to improve the Veteran s experience at the Ann Arbor VA by way of improving the pharmacy s efficacy with the supply of medications and services the Pharmacy can provide. The following will be acquired with this purchase: Increase the inventory turns for the pharmacy to meet the national metric thereby reducing overall inventory costs. Reduce loss of medications to expiration dates. Reduce total FTE hours spent on inventory and missing doses. Improve efficiency of workflow, thereby reducing overall FTE needed. Reduce ordering costs and delays in patient care during shortages. The Control Manager closes the loop of controlled substances. This is a controlled medication system that automatically processes the medications. It saves valuable staff time while helping to meet DEA, ISP, Joint Commission, and other regular guidelines. To protect patient safety and reduce hospital liability, XT Controlled Substance manager provides full accountability of drug movement from wholesales to the pharmacy and patient care area and back to pharmacy. (6) Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted. VIP was queried under NAICS 339112 and there were 412 results. A Keyword search of Omnicell along with the NAICS code resulted in zero concerns. VA Rule of Two cannot be met. NAC was searched and it was confirmed the items can be purchased on contract V797D-30111. Manufacturer, Omnicell, was contacted and they confirmed that they are the only source and they have no distributors. (7) Any Other Facts Supporting the Justification: None (8) A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made: Should a requisition of this nature recur, the market will be surveyed.
