- The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole-source basis, with Bruker Nano, Inc.; 112 Robin Hill Road, Goleta, CA 93117 for upgrading its nanoIR-2 to add a new photothermal induced resonance (PTIR) measurement modality with selective near-surface sensitivity instrument under the authority of FAR Part 13.106-1(b), to be used by Physical Measurements Laboratory (PML), in Gaithersburg, MD. � ***** Sole source determination is based on the need to acquire upgrading its nanoIR-2 to add a new photothermal induced resonance (PTIR) measurement modality with selective near-surface sensitivity instrument. This instrument will be used to enable measuring the nanoscale chemical composition of the sample from depths well exceeding 200 nm from the sample top surface. The purpose of this upgrade is to increase NIST nanoscale spectroscopy capabilities by leveraging a new PTIR measurement modality that provide selective sensitivity from the top ? 30 nm of the sample, even in the case of thick (> 500 nm) sample. A thorough market survey found only Bruker Nano is capable of upgrading the nanoIR-2 instrument installed at NIST with a new PTIR IR absorption measurement modality as only Bruker nano has knowledge of parts, functionalities and software the NanoIR-2 instrument and thus only Bruker can perform upgrades on the nanoIR-2 instrument without compromising the other instrument functionalities. Additionally, the technology for the required upgrade has been patented by Bruker Patent PCT/US17/57171: Method and Apparatus for Resolution and Sensitivity Enhanced Atomic Force Microscope Based Infrared Spectroscopy.� Therefore, no other company identified in the industry is capable of providing the required equipment. Bruker Nano, Inc. is the sole manufacturer and distributor of the equipment identified that meets the required minimum specifications. *****The North American Industry Classification System (NAICS) code for this acquisition is 334516 � Analytical Laboratory Instrument Manufacturing, with a small business size standard of 1,000 employees. *****A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. *****No solicitation package will be issued. This notice of intent is not a request for quotations; however, all responsible sources interested may identify their interest and capability to respond to this requirement. Interested parties that believe they can satisfy the requirements listed above must identify their capability in writing before the response date of this notice.
