Description
(i) This is a combined synopsis solicitation for commercial items prepared in accordance with FAR 12 and 13, as supplemented with additional information included in this notice. The Department of Veterans Affairs, Miami VA Medical Center, has a need for food and nutrition equipment, which includes removal of existing equipment and installation of new equipment, as well as basic training, as described in attached work description. Also attached is LOS form, which must be submitted with quote. See other specifics below. (ii) The solicitation number/agency identifier is 36C248-21-AP-3687. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government. The following factors shall be used to evaluate offers: Price Technical Acceptability The Government has determined in advance that the best value will be the offer with the lowest price among those rated technically-acceptable. Partial submissions will not be accepted. The government will conduct comparative evaluations of quotes. Once the government determines that there is a vendor best suited to meet the requirements of this RFQ the government reserves the right to communicate with only that vendor to address any remaining issues. ADDENDUM 1 to 52.212-2 (a) Gray market items are Original Equipment Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts) for VA Medical Centers.  No remanufactures or gray market items will be acceptable.  (b) Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical supplies, medical equipment and/or services contracts for maintenance of medical equipment (i.e. replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM s warranty and service are provided and maintained by the OEM.  All software licensing, warranty and service associated with the medical supplies, medical equipment and/or services contracts for maintenance of medical equipment shall be in accordance with the OEM terms and conditions. (c) The delivery of gray market items to the VA in the fulfillment of an order/award constitutes a breach of contract.  Accordingly, the VA reserves the right to enforce any of its contractual remedies.
