Description
COMBINED SYNOPSIS SOLICITATION This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. The solicitation number is �75A50119Q00099 and is being issued as a request for proposal. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021 dated 10-23-2020. This acquisition is not a small business set-aside.� The North American Industry Classification System (NAICS) code is 325412. The Division of Strategic National Stockpile (DSNS), of the U.S. Department of Health and Human Services (HHS) Office of the Assistant Secretary for Preparedness and Response (ASPR), intends to purchase Pralidoxime (Protopam Chloride).� The Government intends to evaluate offers and award a contract without discussions. However, the Government may, in its sole discretion, elect to conduct discussions if determined to be in the best interest of the Government. Performance is anticipated to begin September 30, 2021. The period of performance is anticipated to total 5 years. Option periods are subject to the Government�s bona fide need and the availability of funds and may be unilaterally exercised by the Government. The provision at FAR 52.212-1, Instructions to Offerors-Commercial Items, applies to this acquisition. �The Government intends, but is not obligated, to award multiple contracts. The Government anticipates awarding its entire base quantity for each active pharmaceutical ingredient (API) to a single offeror; however, an offeror may be awarded a contract for more than one API.� However, this does not obligate the Government to award a contract for each API. The Government may accept any item, group of items, or quantity of an offer, unless the offeror qualifies the offer by specific limitations.� The provision 52.212-2, Evaluation-Commercial Items, applies to this procurement. Addenda to the provision include evaluation factors, subfactors and evaluation criteria.� Offerors shall include a completed copy of FAR 52.212-3, Offeror Representations and Certifications-Commercial Items, with its offer.� (Note, if offerors are registered within the System for Award Management (SAM) and certs and reps are up to date, make a statement to that effect in accordance with this clause).� The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition.� The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items, applies to this acquisition and FAR clauses applicable include:� 52.219-6, 52.219-28, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.222-40, 52.222-54, 52.225-13, 52.232-33, and 52.222-51.� Other applicable clauses include Health & Human Services Acquisition Regulation (HHSAR). There are no special contract requirements or terms and conditions related to contract financing arrangements.�� The Defense Priorities and Allocations System does not apply to this acquisition; however, HHS reserves the right to exercise priorities and allocations authority, to include rating resulting contracts in accordance with 45 CFR Part 101, Subpart A � Health Resources Priorities and Allocations System.
