U.S. General Services Administration GSA Region 1 Public Building Services JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION PROJECT NUMBER:����������������������������������������� 0ME2078 Agency Name:������������������� Social Security Administration (�SSA�) Office of Hearing Operations (�OHO�) NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED. The General Services Administration currently leases 12,559 ABOA/15,660 RSF of office space at One Portland Sq, Portland, ME under lease number GS- 01P- LME04954 for the SSA OHO. The current lease expires 8/14/2023 with the option for two Unevaluated five (5) year Renewal Options. Approval is requested to exercise one five (5) year Renewal Option for continued occupancy at this leased location without full and open competition. The procedures for exercising renewal options are detailed in GSAM 570.401 Renewal Options and the Leasing Desk Guide Chapter Nine for Unevaluated Renewal Options. DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY�S NEEDS (INCLUDING ESTIMATED VALUE) In anticipation of COVID�s impact on the Agency�s staffing levels, office and furniture designs, SSA has determined to not move forward with any long-term leasing actions until the Agency is able to develop new requirements and revised business processes. Subsequently SSA submitted a continuing need letter on 2/24/2021 requesting a three-year extension at the current location per their new post-COVID procurement policy. GSA has determined that staying in place by exercising one of the two five (5) year Unevaluated Renewal Options in the current Lease to be the most efficient and cost-effective approach to extend the Agency�s tenancy at its current location. REDACTED IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION. 41 U.S.C. 3304(a)(1): Only one responsible source and no other supplies or services will satisfy agency requirements. In accordance with FAR 6.302-1 and GSAR 570.402, it is determined that award to any other offeror would result in substantial duplications of costs to the Government that are not expected to be recovered through competition. DEMONSTRATION THAT THE PROPOSED CONTRACTOR�S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED. GSAM 570.402-5 allows for negotiation with the incumbent Lessor when a cost-benefit analysis (CBA) shows that the Government cannot expect to recover relocation and duplication costs through competition. It is in the best interest of the Government to remain at the current location. Award to other than the current Lessor would require relocation and would cause SSA OHO to incur move and replication costs that would not be recovered through competition. A CBA was completed following the procedures set forth in GSAR 570.402-6 (See Attachment A - CBA). The cost of relocating SSA OHO exceeds the cost of remaining at the current location. REDACTED Staying in place allows the Government to make use of existing tenant improvements constructed in 2013 such as REDACTED and STC Rated Hearing Rooms. Additionally, it is reasonable to avoid spending on Tenant Improvements at this time until SSA develops its new requirements and revised business processes. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE. Per the requirements of GSAR 570.402 Leasing Specialist, Kathleen McCauley, placed an advertisement on the Contracting Opportunities module of beta.SAM on 4/5/2021 for twenty (20) days closing on 4/25/2021. No offerors expressed interest. DEMONSTRATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE. A Bullseye Report on 10/1/2020 found insufficient REIS data for Portland, ME. Negotiation Objectives were determined using 9/29/2020 CoStar report containing seven (7) properties within the DA (See Attachment C). REDACTED OTHER FACTS SUPPORTING USE OF OTHER THAN FULL AND OPEN COMPETITION. In anticipation of COVID�s impact on the Agency�s staffing levels, office and furniture designs, SSA has determined to not move forward with any long-term leasing actions until the Agency is able to develop new requirements and revised business processes. SSA OHO Regional and local management are satisfied with the current location and the service provided by the lessor. GSA concurs. LIST OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN INTEREST IN THE ACQUISITION. None. No Sources Expressed written interest in the acquisition STATEMENT OF ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY SUBSEQUENT ACQUISITION. In advance of an existing lease contract�s expiration, considerations will be given to allow for sufficient time to conduct a full and open procurement. The Government will consider the time and cost of moving from the existing location, and the time and cost to build out new space when deciding whether it is economically advantageous to stay at the existing building or to undergo a competitive action. Additionally, consideration will be given to the customer agency�s mission and security requirements (if applicable) to include limiting any agency space requirements that may be deemed unduly restrictive and thus favor the incumbent. The Government will remain conscious of the effort to continuously encourage competition when practicable.
