Description
INTRODUCTIONS: This is a combined synopsis/ solicitation for commerical items prepared in accordance with the format in far subpart 12.6, streamlined procedures for evaluation and solicitation for commercial items, as supplemented with additional information included in this notice. this announcement constitutes the only solicitation; quotations are being requested, and a separate written solicitAtion document will not be issued. The solicitation is being issued using simplified acquisition procedures. The Request for Quotations (RFQ) number is 1333ND21QNB02193. This synopsis/solicitation constitutes a RFQ and incorporates provisions and clauses in effect through Federal Acquisition Circular (FAC) 2021-05 March 10, 2021. This acquisition is full and open competition. The associated North American Industrial Classification System (NAICS) code for this procurement is 334516, which has a size standard of 1,000 employees. This is an unrestricted Combined Synopsis/Solicitation and all interested parties may submit a quote.� It is being issued using the simplified acquisition procedures under the authority of FAR Subpart 13.5�Simplified Procedures for Certain Commercial Items. The Government contemplates award of a Firm Fixed price contract resulting from this RFQ. REQUIREMENTS:� A description of the requirements for the Multichannel Time Correlated SPC (TCSPC) for DC-QNet is contained in attached Requirements Document.�� COMMERCE ACQUISITION REGULATION (CAR) 1352.215-72 INQUIRIES (APR 2010) Offerors must submit all questions concerning this solicitation in writing, via email, to both the Contracting Officer, Monica H. Brown at monica.brown@nist.gov. Questions should be received no later than five (5) calendar days after the RFQ was posted. All responses to the questions will be made in writing, without identification of the questioner, and will be included in an amendment to the solicitation. Even if provided in other form, the question responses included in the amendment to the solicitation will govern performance of the contract. All interested vendors shall provide a firm-fixed-price quotation for the following: The Contractor shall provide a quantity of 1 stand-alone time-correlated single photon counter (TCSPC), meeting or exceeding the minimum specifications stated in the attached Requirements Document. � Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the �quoted price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror�s FSS or GWAC contract, and the statement required above shall be included in the quotation. (End of provision) General Instructions for the Technical & Price Quotes: Quotes shall be prepared in accordance with this solicitation and are required to conform to the provisions of this solicitation and the instructions of this section. To aid in the NIST�s evaluation, the quote must be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled.� All pages of each part shall be appropriately numbered and identified with the name of the quoter, the date, and the solicitation number.� The Technical and Price Quotes shall all be separate and distinguishable from each other. System for Award Management, SAM In accordance with FAR 52.204-7, the awardee must be registered in the system for award management (www.sam.gov) prior to award.� Refusal to register shall forfeit award. � FAR 52.212-1, Instructions to Offerors � Commercial Items (Reference FAR 12.301(b)(1)) INSTRUCTIONS: � System for Award Management, SAM In accordance with FAR 52.204-7, the awardee must be registered in the system for award management (www.sam.gov) prior to award.� Refusal to register shall forfeit award. Due Date for Quotations � Offerors shall submit their quotations so that NIST receives them not later than 11:00 AM Eastern Standard Time on July 23, 2021.� FAX quotations shall not be accepted.� E-mail quotations shall be submitted directly to monica.brown@nist.gov. �� Please reference the RFQ number in the subject line of email communications and packages mailed.� Offerors� quotations shall not be deemed received by the Government until the quotation is entered in the e-mail box set forth above. � The offeror shall hold the prices in its offer firm for 120 calendar days from the date specified for receipt of offers. Addendum to FAR 52.212-1, Quotation Preparation Instructions: Price Quotation (Vol. I) and Technical Proposal (Vol. II) Incomplete quotations may be considered non-responsive and removed from further consideration. Quotations shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled. All pages of each part shall be appropriately numbered and identified with the name of the offeror, the date, and the solicitation number. Volume I - Price Quotation: � The offeror shall submit an electronic copy of the completed price quotation. The price quotation shall be separate from any other portion of the quotation.� Price quotations shall remain valid for a period of 120 days from the date quotations are due. Contractor shall state express warranty coverage (if applicable). Volume II � Technical � Technical Capabilities: This Offeror shall describe their understanding of the requirements by addressing all minimum specifications stated in the attached Requirements Document.� � CAR 1352.213-70, Evaluation Utilizing Simplified Acquisition Procedures (APR 2010) � EVALUATION FACTORS FOR AWARD: The award will be made to the responsible offeror whose quotation is deemed to represent the best value to the Government.� NIST reserves the right to make an award to other than the lowest priced quoter if the Contracting Officer determines that to do so would result in the best value to NIST. All Technical Evaluation Factors, when combined, are significantly more important than price. Evaluation Criteria: � Factor 1: Technical Capability Evaluation of Technical Capability shall be based on the information provided in the quotation. NIST will evaluate whether the quoter demonstrates that the offered product(s) meet or exceed the specifications of the Statement of Work. Quotations that do not demonstrate compliance with the minimum specifications will not be considered further for award. The offeror needs to demonstrate their understanding of the requirement which described in the Requirements Document. EVALUATION CRITERIA: PRICE � Price will be evaluated for reasonableness, accuracy, and completeness. Nothing in the prohibition shall be construed to� ����������������(i)�Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or ����������������(ii)�Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. �����������(2)�Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to� ����������������(i)�Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or ����������������(ii)�Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. ������(c)�Procedures.�The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for ""covered telecommunications equipment or services"". ������(d)�Representation.�The Offeror represents that� �����������(1)�It�?�will,�?�will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds ""will"" in paragraph (d)(1) of this section; and �����������(2)�After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that� ����������It�?�does,�?�does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds ""does"" in paragraph (d)(2) of this section. ������(e)�Disclosures.� (1)�Disclosure for the representation in paragraph (d)(1) of this provision. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor�s directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
